you need to use 1040NR to file tax return

When you plan to ask for tax return at the end of year, you need to use 1040NR form for federal tax return instead of using 1040 form.Since your 1040NR form federal taxable income is zero, your state taxable income is also zero. Then you could get your state tax back also.
