Assuming that the transaction involves a consideration over $300,000 or, if lower, the buyer does not intend to reside upon the property, you must collect and remit to the IRS a sum equal to 10% of the GROSS sales price." What does FIRPTA mean?
Does anyone go through this craziness? It is pure discrimination. I called the agent and sent a long email to this lawyer. Tell him to talk with my CPA. also I will not sign off for this withholding. I tell the agent I might withdraw the contract if the title company has to withhold, he said he will make lawyer talk with CPA first. I wonder if there is anything more I can do to avoid this stupid withholding. If they do withhold, and I get it back next year, do I need to pay tax for that again. 10% of gross sales is 40K.
