我能扣留这笔押金吗?

房子出租给学生，收了$340押金，说好如果搬走提前一个月告诉我，这钱作为最后一个月的房租。是口头讲好的。她只住了２１天，未提前通知就搬走和新交的男朋友走了，

请问除了21天的租金，我有权扣留押金吗？
