Can I sue the bank?

我和我老婆分别在bank of america and suntrust 有帐户. Last friday,我们发现我开给她
的$1400 check 已经被suntrust chashed. However, her count has no any record of
this check and the balance didn't change. We went to the office of Suntrust.
We showed them the copy of that check. There is a stamp of suntrust on the check indicating it was cashed on June 6. It was posted by BoA at it's website. They sent a request to the headquater(I guess) and told us to wait about 5 business days for their reply.

Today we called them again. They said they sent us a dispute form and we need fill it
before they open a investigation case. We don't think there exits any dispute. It is a serious mistake of suntrust. I guess they want mislead us by a dispute form. Because they do not want aknowledge that they made an unacceptable mistake.
(BTW, when we showed the copy of check to a manager, she said it looks like a mistake)

We are not angry about the mistake they made. Becaue it is a big company and our money will be back later. However their attitude are not acceptable. We called them twice and
visited the local branch. For our feeling, they just want to mislead us and hide their fault. That's not acceptable.

We guess it is common that chinese people always do not know how to use law to protect themselves. We always want things go smoothly and reluctant to fight for our right.
This time we do not let it goes the same way as before.

So our questions are
1.Can We sue Susntrust on this issue???
We think they mislead us and try to hide their mistake. Till today they did not give us any apology.
2. What kind of lawyer do we need, trial lawyer???

We appreciate any help and advice.
