美国言论自由的法律保护

美国的第一修正案保护言论自由，众所周知。

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

但是，美国法院的判决，却说言论自由是有以下限制的
（1）做重要的一点： 美国的第一修正案仅仅是说政府不可以限制言论自由。

（2）那么，私人之间互骂，私人公司因为言论开除雇员，都不是美国宪法保护的。因为别人因为你的言论而回骂，是他们的言论自由。私人公司开除你，是他们的结社自由。（freedom of association）。

（3）第一修正案保证你说假话，不是刑事罪，政府不能把你抓起来。但是说假话造成个人伤害，是民事纠纷，其他个人可以找你诉讼赔偿。

（4）政府可以限制商业言论（做广告）。比如禁止保健品号称自己治癌症，要求医学药品详细列出副作用，都是政府限制商业言论的做法。
