我家换房顶,先交了一半定金,完成后7天之内交付余款。现在的问题是关于“完成-complete “的定义和理解。房顶是换完了。但是1)新换的瓦片在房顶角落的位置直接滴水,2)gutters在换完之后大部分漏水。因为工人直接踩上了gutters 在施工的过程中。和包工头反应之后过来维修了两次,情况依旧没有改观。包工头催逼余款。我很明确你的工作没有完成,我是不会付余款的。包工头大怒,说1) “It’s very common for the corners to leak because they don’t have enough support to handle the weight of water and snow.” 2) “It obviously leaked before the job and you never noticed it.”
然后包工头提出让我付清“余款-暂扣1000$”,他才会启动找人维修gutters only, 修完后我要立刻付清暂扣的这$1000。我要求明确维修gutters 的cost 谁承担?新的shingles 滴水也必须维修。结果包工头又怒,不给我任何明确答案,说“ This is non-negotiable. I know that the gutters were not damaged because I have before and after pictures of the gutters after the job. I’m only replacing them to facilitate a payment from you. If you do not make the payment by XX date, I will be forced to place a lien on your home and file a lawsuit against you for the payment. Then you will be responsible for all the accrued interest and court costs. Make arrangements for the payment as soon as possible.”我想问问应该如何处理这个事情?
1)把余款7000付给包工头,他造成的新瓦片滴水(包工头认为正常现象)和gutters 漏水200%不会管了,除非我再去打官司起诉他。这不是我想要的结果。当初开工之前专门留下一半余款在结束工程后再付就是为了保护消费者的权益吧。
2)根据包工头建议,先付7000-1000=6000,然后他派工人过来维修gutters,但是始终不明确修理费用谁负担?如果是我负担,这和上面第一个选择没有区别。
3)始终强调新瓦片漏水是正常现象.
4)房子是老公的名下,我不在房产里面。签订换房顶的合同是我签订的,老公不在h换房顶合同上面。
