（1）I have talked extensively to underwriters about this situation. They don’t allow a refund. 你买Seller卖，refund否是你和seller之间的事，不能由第三者来确定。seller和underwriters之间的事与你无关。
（2）You purchased the property in Feb / March AS IS and were asked to do you due diligence. 表面上这条不是明确的理由，很可能seller是埋下伏笔，他有很大空间运作这里。
（3）Our multiple attempts to give you the deed failed due to various reasons at the county. We were never notified by the city about the demolition until after it was done in August. 房子不能出售就退还定金。city和county的行为影响了房子的出售是seller和city/county之间的事，seller可以向city/county索赔，但这和退还定金没有关系。
（4）If the deed would have been switched to your name prior to the demolition our underwriters would not give you a replacement property. 首先你买Seller卖，refund否是你和seller之间的事，不能由第三者来确定。seller和underwriters之间的事与你无关。在整个事件中你和underwriters没有任何关系。其次，最关键的 “have been switched to your name prior to the demolition ”是不是既成事实? 发e-mail的人不可小看，这里名堂很多：”If the deed would have been switched”理解成虚拟假设，这句话和没有说一样，如果理解成既成事实，那事情就复杂的多了。用“If”一词是明显的想把事情向复杂的方向引。
（5）My suggestion is to pick a property from the previous lists I sent you as a replacement for Lavergne. 不接受这个建议。
你如果自己打官司，第（2）和第（4）里的“if”要多做研究。可以看出，对方来者不善，是有经验者，且有备而来。没有律师，凶多吉少。（非专业法律人士，试试分析而已）
