请问老猫版主， 我的Earnest Money还有机会拿回来吗？

我本来在9月时拿到一个工作offer. 10月初和builder（Seattle, WA）签约， 11月初公司withdrawn the offer. 因为已经过了30天， agent说没办法拿回一万的订金。 我看了一下合约， 买卖合同第一页， "Seller's delivery to Buyer of Seller's signature on this document together with Seller's receipt of Deposit constitutes "Acceptance" or "Mutual Acceptance," provided, however, if the seller proposes changes to the offer, it shall constitute a "Counter Offer". Mutual acceptance of the counter offer shall occur when both parties have signed and delivered to the other Counter Offer documents, including initialing the documents..." 10月20号，建商说之前我要求GE Profile Appliances （列在合同的Addendum中）他们没有， 要我同意签字换成 Jenn Air的牌子。 因为他们一直没有告诉我具体的型号， 我直到10月底才受到新的Addendum, 所以我没有initial那页。请问这一条可以作为是建商的“Counter Offer”吗？ 如果可以， 那么因为我没有initial, 之前的 Mutual Agreement 可以算失效吗？ 或者可以从那天开始算30天吗？

买卖合同第2页，"In the event Buyer fails, without legal excuses, to complete the purchase of the property, the earnest money shall be forfeited to Seller..." 请问没有工作是”legal reason“吗？
