Heard of "Adverse Possession"?

Depend on which state you are at, how much land your neighbor fenced out, ... You migwant to setup a fence bordering your neighbor's fence (talk to them first)... Fixed the tree, take the land...

At the same time, I would hire somebody to prune the tree to avoid further damage to your own house. Keep photos and receipts. You can decide whether ask your neighbor to pay for it or not, later.
