Help- US visa revoked but planned to marry a US citizen
1, I am a Chinese but in Canada now and going through divorce process. I can stay in Canada legally until next Aug.
2, I entered US by B-2 visa and stayed in US with my girlfriend who is US citizen. I wired most of my money to her bank account because we want to do business together
3, I signed the divorce paperwork but was caught at US custom because they suspected I attempted to get myUS citizenship by the fake marriage with my girl(I wired money to her and just signed the divorce paperwork) and they believe that I have no attention to go back to Canada. My visa was revoked.
4, we have been investing and got profits till now.
5,I received the divorce verdict and want to move to US asap to be united with my girl. With the record of visa being revoked, should I get my B2 Visa back first to demonstrate that I am innocent or marry my girl and start the immigration process.
-Technically, you can try to apply for the B2 visa again, but I think it is very difficult for you to get the visa, and even if you get the visa, you still have the same trouble to enter US using the B2 visa. Because you have the B2 revocation record in the system, they still will question you about the immigrant intent.
So, you may ask your fiancee to sponsor you to get the K1 visa in China to enter US to maary her, or she come to Canada to marry you and then, sponsor you to get the K3 visa or immigrant visa in China to enter US.
