我2009入境的I-94只给到护照有效期(9/2011)， 护照已经renew．但是CBP说不用改我可以用I-797上的I-94(expired 2012).
-Not true. Your H1 status will expire in 9/2011(when 2009入境的I-94 expires).
八月初要递485, 是不是一旦485已递, I-94也无所谓有效期, 是吗?
-Correct. But your status will not be H1, but AOS and you have to use EAD to work.
Do I need to get a new I-94 now?
-If you want to keep the H1 status, your employer needs to file the H1 extension for you or you just need to go outside US to get the H1 visa to come back to get the new I-94 at the port of entry. If you do not want to keep the H1 status, you do not need to do anyting, but you cann not work until you get the EAD (you need to file I-765 and the I-485 together to get the EAD).
My suggestion is that you may ask your employer to file the H1 extension for you before your H1 expires so that you can continue to work. Otherwise, you have to wait for the EAD approval which may take 2 to 3 months or more.
