-Yes if you are a Canadian citizen or you have a valid H1 visa (stamp) in your passport. Otherwise, you have to go to a US consulate outside US to get the H1 visa to come back .
2)If I apply for H1 extension, when is the start date?
-From the date your current H1 I-94 expires in 9/2011.
e.g. my current H1 expired 5/2012, then on I-129 petition, i will ask for 5/2012-5/2015? or 9/2011-9/2014?
I can extend 3 years.
-If your 6 year H1 still have at least 2 years to go, then you can extend your H1 for another 3 years from 9/2011. Otherwise, you only can extend your H1 for the left H1 of the 6 year limit plus one year beyond the 6 year limit (using your approved I-140), e.g. you have one year H1 to reach the 6 year limit (you have used 5 year H1), then you can extend your H1 for another two years.
