对不起，没说明白。在H1第4年我们递的NIW140,递近2年才处理（第6年）补材料被拒，然后上诉。这期间又递的第2个NIW140（已批，但H1已第7年）。

上诉被拒是律师问题。
我们找的律师是朋友介绍的中国人，他是consultant。他跟我们说，他为美国人开的律师工作（我们是电话联系），我们就相信他了，而且我们的所有case都是美国人签的字递的，我们从来没有怀疑过律师的问题。直到今年初，AAO来信告诉哪个美国人不承认是我们的律师，而且从来没和这个中国人合作过，这时才知道。AAO让作Motion说明情况，我们亲自去找哪个中国人，他拿不出任何依据给移民局证明哪个美国人是我们的律师。因此，我们只好自己作motion，说明整个经过。但今天收到移民局来信The motion is dismissed.

请问1 这种情况还有什么补救办法吗？

2 我们需要上诉这个中国人吗？
-I do not know because this is not immigration issue and dyou may post this question to "法律咨询".

3 对已批的case会有影响吗？
-No at all.

Then, you do not need to worry too much because you can use your approved NIW I-140 to extend your h1 beyond the 6 year limit again and again at a three-year interval and your spouse and kid and extend their H4 with you and your kid can continue to study with the H4 status.
