急问！关于H4延期

情况：我H1，lg是H4，下个月20号到期。我的公司正准备帮我们办延期（H1用加快），lg现在用EAD在工作，上周刚通知他六月初回国出差。

我们自己的律师说，lg的H4延期不能现在递，要等他回来。可我公司的律师说，只要递申请的时候他人在美国，且在旧的H4过期之前回来就没问题。

我现在很糊涂，到底可不可以现在递我lg的H4延期申请？
