1. 我还没有file I-485, 但是priority date是current。但是我有一个问题，不知我的out of status是从什么时候算起。A公司H1B approve (but extension request denied) notice上说The denying reason is that your H1B status expired on July 25, 2024,
-This date should be your H-1B I-94 expiration date from M Company. From this date, you were out of status, but you still legally stay until December 11, 2024, the date M Company withdrew the H-1B extension petition.
and the petition was filed on October 25, 2024, so you failed to maintain your nonimmigrant status. 公司律师跟我都不知道July 25, 2024这个时间是怎么来的，因为我的M公司的pending的H1B application receipt notice date是4/24/2024。M公司之前的公司我是从2月份离职的。所以我不清楚我是从 7/25/2024开始out of status还是应该更早，从M 公司之前的公司离职时，之前的有效H1B就已经过期了，i.e., 2月开始就out of status了。如果7月开始我out of status, 那是不是意味着我只有大约30天的时间可以file I-485，
-Yes. Try to send out your I-485 application on January 18 around to allow USCIS put it in the system before January 25. You may do the medical examination now because USCIS require the completed I-693 (medical examination) must ne submitted within the I-485 filing at the same time.
但是如果从2月开始就 out of status，我是不是就不能file I-485了？因为已经超过180天的out of status了？

2. 我的专业是machine learning/AI相关的，是不是会比较敏感？
-Yes. So, I do not suggest you leave US until you get your green card. Just file I-485 as soon as possible and apply for the EAD at the same time as the I-485 filing. Discuss with the employer (A Company) that you need to stop working until your EAD is approved and ask the employer to keep the position for you.
Fortunately, I-485 filing is based on B Form for December 2024 and January 2025, so you can file it. Provide the copies of the I-129 petition Receipt Notice (i.e., the receipt notice for H-1B extension filed By M Company), the old H-1B I-94 with the H-B Approval Notice from M Company, the H-1B petition Receipt Notice filed by A Company, and the H-1B Approval Notice from A Company (without I-94) with your I-485 filing.
很担心visa出问题，因为孩子家人都还在美国。也怕绿卡申请会有问题。
