我跟我之前file I-140的律师联系，希望帮我file I-485，但是律师不愿意帮我file。她认为我out of status超过了180天，因为她觉得因为M公司的pending H1B case 被withdraw了，所以out of status日期就需要看之前P公司的End of employment day, which is Feburary 2024。
因为End of employment的时候I-94就失效了。我刚刚查到USCIS给的H1B status expired date July 25, 2024, 是指P公司的H1B被 automatically revoke date。但是我的移民律师认为不应该用这个revoke date算out of status date, 而应该用 End of Employment date, which is > 180 days。
您认为out of status时间是应该从End of Employment date开始算还是从P公司的H1B revoke date(P公司H1B revoke之前M公司H1B申请一直pending状态) 开始算啊？
-Did you mean you had never worked for M Company even if M Company filed H-1B petition for you? If yes, then you were out of status counted from the expiration date of your latest H-1B I-94, i.e., February 2024, from P Company. I agree whtin this lawyer.
所以她认为我申I485有很大风险，因为审查I485跟H1B的不是同一个department.
