背景调查与EEOC

我因 file EEOC 被单位辞退已经两三个月了，一直在找工作，还没找到，因为已经没了工作可能很难再找到。不过最近面试过的一个公司据说在准备给Offer，但是需要做背景调查。我担心的是如果背景调查查出我曾经file了EEOC，会不会就被拒了？背景调查能查出EEOC来吗？如果他们跟原单位联系，原单位会说出去吗？他们会跟单位打电话吗？如果打的话都问什么？我是否应该跟单位和解撤掉这个案子？现在还来得及吗？应该怎么做最好？

非常急切想得到各位的帮助！多谢！！！
