There might be a risk.

There is an employment law that requires employers must provide employees up to 12 weeks/year unpaid leave for family and medical reasons. During the leave, employer has the responsibility to hold the position for the employee. If your unpaid leave falls into that category, I guess the employer can replace you with someone else without violating the law.
