GC application even if that person doesn't work for it currently. Remember employer-based GC is for future employment, not current one. So talk with your previous empolyer nicely to find out a workout. Most companies are not familiar with these kind of immigration stuff, so a good immigration attorney comes handy at this time. It may worth for you to find one even if you have to pay his service by yourself. Good luck.
