I assumed that you worked under one employer.

if that is the case, you should go to your employer and ask them to correct teh overwithheld taxes of SS and medicare by filing sepecific form(maybe Form 843, I do nto rember the name of the form). You cannot get it back from Tax return( form 1040 or 1040NR) which are for multi employers people work for.

By the way, just file Form 1040 for ur 1st question.
