AB1436相关时间段的解释

搞得人心惶惶，我试着解释一下到底什么时候可以收租，什么时候驱逐，不对的地方请指正。本人和加州没有任何关系，纯属狗拿耗子。

简介: 就是2021年4月1日（离今天7个月）以后就不能再欠租了，再欠租可以马上驱逐。但是2021年4月1日以前的欠租，不能在2022年4月1日以前用来做驱逐的理由立案。

第一，Covid Rental Debt 定义COVID欠租

(c) “COVID-19 rental debt” means unpaid rent or any other unpaid financial obligation of a tenant under the tenancy that accrued during the covered time period.
COVID欠租，是指在法律涵盖日期内的欠租，定义如下：

(b) “Covered time period” means the time period between March 4, 2020, and the earlier of either of the following:
(1) Ninety days after the termination of the state of emergency.
(2) April 1, 2021.

就是从3／4／2020 到：（1）疫情结束90天（2）4／1／2021；两者中早一个日期, 这个时间段的欠租。

如果疫情结束早，相关时间段也提前，如果州长宣布疫情紧急状况于10／1／2020结束，那么九十天以后截止日期就是12／31／2020  (谢谢守月指正)

如果疫情结束晚，那么4／1／2021是截止日期

第二，Cvoid Debt什么时候可以驱逐？

The bill would prohibit a plaintiff from bringing an cause of action to recover COVID-19 rental debt until 12 months after the end of the covered period. 15 months after the date the COVID-19 state of emergency terminates or April 1, 2022, whichever is earlier.

本法禁止原告在（1）疫情结束15个月，（2）4／1／2022；两者中早一个日期前，以讨Cvoid欠租的名义立案。

就是2021年4月1日（离今天7个月）以后就不能再欠租了，再欠租可以马上驱逐。但是2021年4月1日以前的欠租，不能在2022年4月1日以前用来做驱逐的理由立案。

当然，如果疫情早结束，整个时间段往前推，从疫情结束90天开始算。如果州长宣布疫情紧急状况于10／1／2020结束，那么九十天以后就是12／31／2020，也就是说12／31／2020以前欠的租，要等到12／31／2021要。
