买房子,首付80%,贷20%的房款。其中房子所在的地价都比贷款金额高。
Lender找人appraisal后,说房子地下室有水痕,要修;或者找professional写证明漏水修好了。否则不给贷款。Seller既不找人修,也不找人证明修好了,反而要求我们找人写证明不漏水了。
Lender's guide is pretty like a machine. Not with one peron opinion. If appraisal report say possible 漏水. You must provide some professional report (can be from a general contractor, home inspector or the appraiser) to certify the property has no water leak. or the leak does not affect the house safty, livability, marketibility. Lender is not expert in contrstruction. It need a reliable third party say the property is sound.
我们作为buyer找不到人写这个证明,都怕有责任;我们也不能写假证明(mortgage fraud). 现在就僵在这里。
我觉得这个问题诡异在于:
1. Lender-我们credit,首付,收入水平相对于借款简直相当于大学生上小学。lender要求的东西如果我们做不到,所有其他人都不会做到。现在lender中有人propose repair escrow account,就是我们再从lender借高利贷5000元,付10%手续费,然后我们就能close。这是不是lender故意卡我们?
residential lendeing is highly regulated business. I do not think lender故意卡.
2. Seller-态度特别强硬,什么都不做,都让我们瞎折腾。地下室漏水的问题,我们看房第一天就问他,他用书面回答是以前shower漏,现在修好了。结果房检和银行同时看出问题,他又说是gutter漏水,landscape漏水,地不平。反正不止一处漏水。seller disclosure也没说漏水。如果他说实话,我们就不会折腾买这个房子,能不能告他?
This is pretty much point of negotiation. In many states (I am in Texas) , if property not qualify the loan, buyer can terminate contract and get earnest money back.
3. 我们现在房检,贷款,律师费花了一大堆,结果房子买不到,还生了一肚子气,高手说说咋办啊? when you buy a several thousand propertym spend a few hundred is not a lot of money.
