急问一个eviction 的问题

3月份由于暴雨房子造成了损坏， 一直找不到合适的人和公司修， 房子的热水坏了， 租客3月份没交房租 ，现在要求免费住到5月。合同现在是month by month,我们 请求租客搬走，并给予一定的补偿， 弹珠克坚持要免费住到5月份，而且说要告我们 不能及时修理热水。 我们可以发Eviction 信吗？谢谢!
