Noncitizen spouse estate tax threshold in California?

最近在准备trust, 律师说因为我们都不是公民，一方配偶意外身故，他的那份财产只有110,000免税，其余的subject 45% 的遗产税。查了网上，怎么联邦有5.43m 免税呢，有谁知道么
