I doubt you will have any luck suing the bank. Because

on the contract the seller (bank) usually said knowing nothing about anything.

Septic tank is simple to maintain. Hire some one to clean it and snake through the pipe from tank to house if needed. A couple of dollars good for 3 years. I have two of them. Just cleaned few days ago.
