合同中应有以下条款

Possession： Seller shall deliver to Buyer possession of the Propert in its present or required condition， ordinary wear and tear excepted： upon closing and funding。

如果卖方（银行）不能按期执行，你有权退出并拿回诚意金。

还有一种情况是短期租约（temporary residential lease form），如果你同意的话，就按租约执行。
