房客跑了？ 是不是我legally take the property back

各位大小中地主，

有个租客，这个月没交租，发信，打电话，留言，一概不回。 我上星期给他一个信 （pay rent or quit), 告书他5天不付， 就take legal action.

结果才4天，其他的房客告诉我他前天搬走了， 而且这个房客和我同时看见了他的房间全部都空了。就是留下了钥匙，没有留下任何别的东西（包括新地址和联系方式）。

请问，是不是他 by default 就是abandon the premise. 我已经legally take the property back due to no payment on rent and tenant moving out volunterrly. 我不想再去法院take legal eviction. (也没有地方投递法院的通知）

just want to make sure that I can change the lock.
