can back out, then I guess if the buyer wants to back out, he needs to lose his deposit, is this the only loss he will suffer? How about the loan he already gets , how about the funding, and the downpayment that is already made?

What loss the seller will suffer if he doesn't want to sell within 3 days after escrow/close?
