help on evicting bad tenant.

on dec.10.demand for rent notice sent.dec 21th.eviction notice sent .tenant paid me some .not full .the question is if I place a court case now and pay the court fee .at that time bad tenant pay me full payment. does that mean the eviction expire .so I even loose my court paper fee. thanks first.
