We are trying to buy a house build in 1999. The HOA of this house has filed a lawsuit agaist their builder a couple of month ago. In the file, the HOA complained about defectives in stairs, foundations, fences, stucco system, windows, doors, roofs, chimney caps, floors, cabinets, tub, sinks, plumbing components, fir alarm, electricals and etc.
Now, we are trying to understand:
1. is this lawsuit normal? are these complains pretty standard for this kind of lawsuit? Are these defectives managable?
2. what will be the effect of this lawsuit on our loan application?
3. why there are still some pending houses in this HOA if this lawsuit has a huge negative impact on loan applicaiton?
