patent is a good start, but people are copy cats for sure

There are many brilliant ideas died on paper, because of it. They do get around it, because "A patent cannot be obtained on a mere idea or suggestion. Methods of doing business and printed matter cannot be patented." You best chance is to secure a patent, and get VC to push out a working product to get ahead.
