求助：追尾被告怎么办?

去年二月的一个晚上，老公开车不小心在一路口发生轻微追尾，前面的车尾和我们自己的车都没有明显撞痕，警察来过写了报告，我们也报了保险公司。当时对方叫了911，所以救护车也来了，把对方车上的两个人都检查了一下，没事后我们才离开。之后，保险公司包修了对方的车，车主倒没事了，那个乘客却一直跟保险公司扯皮，估计他确实没受伤，所以一直没从保险公司那得到好处。一年过去了，却突然收到法院的通知，说是这小子把我们告上了法庭，索求伤害赔偿五十万。法院要求三十天内有答复。

这样的事情大家碰到过没有？怎么处理才好？有不有可能dismiss the case? 如果真上法庭，需要注意些什么事项？
