DO NOT rely on your insurance company. Yes in the negligence case the plaintiff has to show real injury and the law will put the plaintiff back to the prior-injury stage, but technically the plaintiff can request damage of pain and suffering, which is totally dependent on the court evaluation. You need to find a good tort lawyer to fight for you.
