Everyone off WL post 5/1 was already committed to another school

This is completely legal and naturally acceptable.

Otherwises there will be no WL mechanism (post 5/1).

The cost is giving up the deposit. 

Then again, some top schools don't even charge a deposit - they have complete confidence in you AND in themselves.
