Following is the summary of new Bill of "Immigration Innovation Act of 2013"
The new Bill includes a number of aspects that would greatly improve the H1B visa program. The changes are much needed as the H1B visa quota allocation runs out quickly each year - because the demand grossly outweighs the supply of available visas.
The Bill has been warmly welcomed by many industry-leading US corporations that want the visa quota allocation to be aligned with their employment needs for H1B visa workers.
Regarding the H1B visa the Bill specifically focuses on these key benefits:
1) Increase the cap on the 65,000 Regular H1B's - to 115,000 availability
2) Remove the cap on the 20,000 ADE H1B's - so that it is Unlimited
3) Establish a market-based demand H1B visa quota escalator system, so that the cap can adjust to meet the demands of US businesses and the economy (includes a 300,000 visa allocation ceiling)
4) If the cap is hit in the first 45 days when petitions may be filed, an additional 20,000 H1B visas will be made available immediately.
5) If the cap is hit in the first 60 days when petitions may be filed, an additional 15,000 H1B visas will be made available immediately.
6) If the cap is hit in the first 90 days when petitions may be filed, an additional 10,000 H1B visas will be made available immediately.
7) If the cap is hit during the 185-day period ending on the 275th day on which petitions may be filed, and additional 5,000 H1B will be made available immediately.
8) Authorize employment for dependent spouses of H1B visa holder
9) Increase portability of high skilled foreign workers by:
- Removing impediments and costs of changing employers;
- Establishing a clear transition period for foreign workers as they change jobs; and,
- Restoring visa revalidation for E, H, L, O, and P nonimmigrant visa categories
The new Bill is great news for US businesses and for Foreign nationals, who would both benefit in the increased numbers and availability of H1B visas.
