Did you ever worked in 2005? Did you have income in 2005?

If you never worked in 2005, it is hard to convince IRS that it takes you whole year to find a job. So you
don't have intention to find a job. You can not use it.

In the second sentence that you quoted above, pay attention, it is "AND", not "OR". SO if you never worked AND have no income, you can NOT use it.

Otherwise, you can use it.
