请教老猫及各位热心朋友-- 超市偷窃问题

我老婆前几天干了胡涂事， 在SEARS偷窃被抓了，当时保安把超市的发票给了警察（cash register 打出来的）证明失窃物品金额为60刀，当时我们脑子一片混乱， 没有去证实， 第二天开始怀疑， 我们马上回到那个店里买了相同的物品，发票金额是24 刀， 我们发现sears 当时有60% off sales (5号- 12号），而事件发生在6号， 却不知什么原因打出来的是没有60% off 的价格 （5号以前的）我仔细看了我买到的物品， 发现以前的标签还在（60刀），上面另外贴着新的价格（with 60% off), 我去找经理， 经理不在， 另外一个办事员说这种情况下他们就是按以前的价格呈报。

因为50刀是分界线， 我查了TEXAS 的州法， 是这样的：value of item: the fair market value of merchandise of same time and same store where it happend. 是不是说应该按当前的价格计算价值？ 还是应该按以前的？ 是不是sears经理故意报复？我们正在办身份，不想因此而受影响，应该增么办？是不是应该去告ＳＥＡＲＳ故意夸大事实以加重罪行？　请大家帮忙出一下主意，　先谢了。。。
