确切的说， 即使harvard 不拿政府funding, 联邦法律也禁止它搞基于 某些protected classes 的歧视

protected classes包括：

• - Race or color
• - National origin or citizenship status
• - Religion or creed
• - Sex
• - Age
• - Disability, pregnancy, or genetic information
• - Veteran status

这也是为什么harvard 只是否认它没搞歧视， 而不是辩解可不可以歧视！
