"failure to give right of way to emergency stopped vehicle" means you were supposed to slow down to 20miles/hour or move to another lane when there was vehicles stopped on the shoulder.
Otherwise it would be very dangerous.

I personally do not think you can get away.

Just drive safely and within speed limit.
