It does not matter.
If your father found the last will is unfair to him and he is better off if the estate were distributed intestacy, he should have challenged the will if he has a reasonable doubt that the last will was executed while the testator was incompetent or udner undue influence. It does not matter whether there was a previous will or not. They can go by New York State's intestacy law, if there is not valid will.
