基本上如果您的情況合於下列三個原則您可以提出申請

a.) committed only one crime;
b.) the maximum penalty possible for the crime did not exceed imprisonment for one year
c.) the noncitizen seeking admission was not sentenced to a term of imprisonment longer than 6 months.

同時老貓過去的了解是您需要完成probation之後移民局才會處理您的申請案,然而美國移民法規最近幾年有許多更新的措施,所以個人會建議您直接與移民局當地辦公室聯絡了解一下目前相關的規定.
