Buddy,
1st: ur loan agent is a bad guy to offer you the loan with option of prepay penality.
2nd: check ur original loan document, it should have explnation for prepay penality.
3rd: if not clear, call loan sevices rep to find out.
4th: Base on my knowledge, prepay penality will applied for refinance, not for property sold after a few month of accept the loan.
