在SAN JOSE, 加州,最近买了个房子。5月23日,和一对印度夫妻签约出租。6月6日搬进。他们交了$500押金。当时想,都是移民,应该会比较老实。
前天(6月1日),我们做CREDIT CHECK,发现这个印度人信用极差。这两年,开了十几张信用卡,欠了银行十几万,就不还银行了。现都送到COLLECTION AGENT那里去了。
我们当天就对他说,不租给他们,因为信用不好,同时,把$500支票邮寄到他家。今天,有个自称是律师的人打电话来,说要我们下个星期法庭见。
我认为,有两点,我可以悔约,请大家评论:
1。 合同是以夫妻俩人的名字申请的,但只有丈夫签字了。所以,我认为合同是无效的。
2。在合同中,有个条款:
15. PHYSICAL POSSESSION: If Owner is unable to deliver possession of the premises at the commencement hereof, Owner shall not be liable for any damage caused thereby, nor shall this agreement be void or voidable, but Tenant shall not liable for any rent until possession is delivered. Tenant may terminate this agreement if possession is not delivered within 14 days of the commencement of the term hereof.
我能不能说我亲戚要来住(的确有个亲戚6月16日来),所以我是unable to deliver possession of the premises。从而达到悔约?
