It will be difficult.........

to hold the previous owner after 2 years based on the facts:

1. If you have an inspector check it before purchase and he fails to reveal the window leakage, the inspector USUALLY is responsible for it when the issue is raised within one year.

2. For a new house, the builder RARELY offer more than one year warranty (excluding constructive defects which is 10 years in CA).

Why didn't you notice it earlier?
