It reminds me of a story I heard a couple of years ago. It happened in a gym of NY city. A guy left his ipod on the bench when he was changing, another guy didn't see the ipod and accidently swept it on the floor. The ipod was worth $300 at that time. Small court judge ruled in favor of the guy who broke the ipod as the judge concluded that a gym bench was not the right place to leave the ipod.
