regardless of whether the software can be patented, his employer owns the copyright in the software, or any other intellectual property in any form, if he signed an employment contract that assigns all the intellectual property to his employer at the time when he accepted his employment.

whether this type of contract is enforceable is state law. and i haven't heard state actually prohibit this type of contract.
