请教如何处理公司私用我的401K

大家好！

我在一小公司干了几年，马上要跳槽。
才发现公司没有把每月扣除的401K投到任何地方。
头儿说等公司有了钱会慢慢还我。
我请他写一保证书说分期还我，他不干。
他说: 你要是不走我马上还你。
请教我应如何做？共欠5万多刀,值得请律师吗？
