if she chose to fight, she might have to fight in a special court, I think it is the Court of International Trade, with its own rules and procedures. I heard it is quite expensive to do, but relatively fast. if she can't recover the attorney fees, then even winning the case does not mean much to her.

definitely go talk to a lawyer though. should call her State Bar, and ask their referral for a Trademark lawyer with ITC experience.
