重婚罪

我的一个朋友，他在国内结婚了，有了个14岁的女儿，老婆女儿都在外了，女儿在这里读美国的学校，老婆做导游。日子过的满好的，但是温饱思淫欲，认识了一个小姐（也是中国人，那我们就会理智的理解事情的发生了）小姐以为他是个很有钱的人，在两年前为他生了个女儿。现在这样的情况他在美国的法律上是重婚还只是通奸呢？
外人可以到哪个部门告他吗？还是只有他的原配老婆？怎么定罪呢？
