李永告雷神 (Yong Li v. Raytheon)完整版
李永(“李”)是软件工程师,在中国完成两个学位。她于90年随夫去英国,先后在三家不同的公司搞软件开发。她于1998年初被雷神公司招聘到美国麻省Marlborough市做导航系统控制开发。
雷神公司是美国第三大军火财团,位于Lockheed Martin 和波音 Boeing 之后,以造导弹为主,其雷达导航业务面向全球,是一个拥有年营业额200亿美元($20B)的跨国公司。
进雷神工作之后,李发现阿毛阿狗都在搞软件。李所在的数据库开发组大都是女的,组长Gayle McEleney只拥有法国文学学位,在公司混了二十多年以写文件为主,借着九十年代经济泡沫,各软件组空有合同,无人开发的当口进了数据库组并做了组长。本来麻,技术上不行,做领导未必不可。但是这个Gayle特别喜欢修改李的程序,这也是她学习软件的法子,再简单的程序只要她看不懂,就要李重写,于是滑稽的事来了。Gayle看不懂李写的条件语句:

她认为条件A和条件B在一起不容易懂,要李重写。李认为没有必要改,于是把如果(if)和此外(else)颠倒一下就准备糊弄过去。谁知25岁的小组长Belinda Gunn认真贯彻执行领导意图,她非常聪明地把程序改为:

然后Belinda要求李按此逻辑修改十一个类似的数据窗口。李和Belinda用电邮讨论了两个来回,Belinda固执己见,李就把这个电邮发向几个组员请大家讨论。组长Gayle不懂装懂回了电邮表达了她的两美分(two cents),她说Belinda改错改的好(也不知道错在哪),Belinda是小组长有权做决定。看不贯Gayle的蛮横,借调来的组员Conall McGleenan回应了爱尔兰两便士 (Conall是暂时从爱尔兰借调来的,他拥有工程博士学位),他指出条件(if)语句不用分,而且Belinda的程序造成不必要的重复,如果有谁看不懂,加一句注释行就行了。一看有人替李说话,新上任的经理Jen Lewis登场了。
Jen Lewis 是个极其美艳又雄心勃勃的女性。正好雷神公司提倡多元化,总有一定名额的经理位子留给少数族裔。Jen 作为白人女性,也就顺理成章成了少数族裔里的特权阶层。确实,自从李来美,软件中心实验室总头的高位换了好几个,全是白人女性。Jen 刚出道,想做实验室经理恐怕还要熬上很多年,但是已经有人说俏皮话作预言了。李在2000年曾经在气象雷达组为Jen工作过两月,那时Jen还不是经理,感觉Jen很聪明,工作积极主动,一看就知道是准备当官的。果然Jen很快做了经理并兼管数据库这一滩。本来李和Jen的关系不错,只是李有一次试图跳槽到另外一个经理Waseem Naqvi那儿工作没有成功,问题就来了。Jen从此之后对李的态度就变了,无论组里有何争论,Jen总是反对李。这一次居然有重量级的Conall替李说话,那怎么行。Jen 赶紧召集午饭后会议,希望大家支持小组长Belinda。另外一个组长Shari Sewell (这个组官比兵多)在会上说她不做判断谁的程序好,她说了隐私问题,认为讨论应该只限于李和Belinda之间。李当场问Jen谁的程序好,Jen说她不做判断谁的程序好。李提出请Waseem和另一个高级工程师Mark Edry做决定,Jen说不,她说Belinda是组长应该说了算。Jen 希望大家支持Belinda, 谁知Conall, William Kerr和 Ian Johnson 全都为李说话,反对Belinda的程序。Jen气坏了,她把这三个男的撵出会议室。无人替李说话,Jen就变了,她狠狠地对李说李用这总技术讨论打击组长。李没有反应过来打击(attack)这个词,李的英语并不是那么好,但是她感觉到了Jen的可怕,有点要打架的感觉,李能感到Belinda 脸也变了,Belinda有点吃惊。李说人是平等的,李说如果Belinda坚持要改,李可以改。Belinda很难过,她认为她的程序好。会议不了了之。
回到办公室,李发现高级工程师Mark Edry(MIT毕业)也回了电邮,他说李的程序更易懂,并指出俩人思路不同。这当然是马后炮,谁也改变不了Jen的决心,那就是顺我者昌,逆我者亡。到了快下班的时候,Belinda发了一个电邮要求改程序,李回问到底改成谁的,Belinda说改成她的,李说没问题。于是十一个窗口都改成如果(if) 套如果的笨语句。
第二天,李心有余悸试图改善关系,她碰到Jen就说真没想到Belinda这样脆弱,真对不起Belinda,Jen反而又硬了,她说李把电邮发出去对Belinda不公平,她可从来也不想是否对李公平。
可能是上面察觉到了什么,李的行政经理(section manager)Tony Casieri很快把李调到别的组。Tony很快也被Jeffery Wilson取代。Jen对Tony没有影响力,对Jeff可以说是自家人,他们都属于德国项目P1的核心圈子,实权派。李在别的项目干活,如果还待在 Jeff的行政部就不是好事。李曾经对Jeff提过Belinda改程序的事,Jeff说如果组里开会大家作决定要改那就应该改。李说什么大家,就是 Gayle一个人决定。Jeff说李若不同意Gayle的决定应该当场提嘛,李说提也没用,Gayle就不懂。
到年底,Anna Selwyn 把李调到自己的行政部,从此应该彻底摆脱Jen的阴影。谁知过了年雷神公司开始作上一年度总结鉴定的时候,问题又来了。
2002 年一月,Anna 把鉴定初稿交给李,李一看竟然有一条说李在数据库组工作的时候不尊重领导。李留了个心眼,她把同事William Kerr(借调的爱尔兰工程师)的电邮呈给Anna,电邮说William和Conall一来数据库组就发现李受到不公平待遇。见有物证,Anna说她再查查。李还不放心,她赶紧同回到爱尔兰的Conall联系,请他向Anna解释数据库组发生的事,Conall回复说除非Anna询问他,否则不符合规则。也不知道Anna都作了些什么,反证她把“不尊重领导”这一条去掉了,并加上一条李在数据库组“贡献重大”。李没有想到Jen居然试图在鉴定上作手脚,李向Anna提出Jen应该向李道歉,Anna说Jen将来要在雷神公司爬到很高的位子,如果向Jen索取道歉,李就会树立一个强敌。李离开 Marlborough来到邻镇Sudbury分部工作。
新年一过,各种培训也展开了,每年一度的道德培训又开始走过场。这一回李不再漫不经心,她认真听取人事部的上访渠道,决定把Jen的事情反应上去以免后患。李找到雷神亚太协会头头康(Richard Kung),康要李见雷神的公平就业办公室EEO经理Steve King。三月分,李拿着那个所谓打击Belinda的电邮讨论去见Steve,Steve听了来意,说这是去年夏天发生的事,太晚了,以后有事立即来找他。
十月份,公司丢了几个合同,裁人的流言开始漫传。李认为这一回一旦被裁,Jen Lewis的事就再也没有机会提了。因此李写了一个上告文,把在数据库组发生的事简单叙述一下,指明Jen对李不好就因为李是中国人。EEO的Steve 委派Mattie Ervin做调查。裁人已经开始,EEO被砍,Mattie已经离开麻省到佛州(Virginia)的雷神分部,她只能通过电话做调查,然后告诉李歧视指控不成立。李要求看调查被告,Mattie说给人事部的Megan Turley了。李找到Megan,Megan不给,李坚持要一个书面结果,Megan就写了半页空洞的信打发李。李又向公司道德部索要Mattie调查报告,道德部官员Tim Shultz说是要保护被调查者隐私,不能给李看报告,甚至连被调查者名字都不能说。李从Mattie那儿能得知Conall和William并没有被调查,李认为调查不公平。
过了年(2003),Megan不耐烦李的纠缠,她要李去见公司的Counselor John Didio谈。李就向Didio索要报告,Didio问了李一大堆泛泛的问题,诸如来美多少年阿,对美国感觉如何,家里有多少人阿等等。李向他要报告, Didio说Megan管报告,如果她不给这事就不成,李只有找律师想办法。李问Didio能否介绍律师,Didio说他是为公司办事,不能为李介绍律师。
二月份,李将要被外派到佛州美国航天部NASA的Langley研究中心工作。临走前,李在走廊上碰到人事部经理Arthur Buliung。Buliung是个和蔼的小老头,很容易说话,他答应就李的事再向Conall和William做调查。
七月份,李在Langley收到Buliung电话,他说他问过Conall,Conall说的和别人没有两样。William不回电话,Buliung也没有办法。李要求Buliung把调查结果电邮过来,Buliung回了一个短邮说等李回到麻省会当面谈。
十月份,Jen Lewis的好友Ian Mitchell在麻省被提升为部门经理,管理着上百号人,并兼管外派到Langley的几个人。Mitchell是苏格兰人,比李早一年从英国招到雷神。同是新移民,Mitchell得天独厚,苏格兰口音在英国不吃香,在美国很牛,特有的英国幽默使Mitchell在雷神公司如鱼得水。 Mitchell意气风发,和Jen Lewis同办公室几年后,就般进了带窗户的经理办公室。
十一月份,Langley的工作要完了。李和家人两地分居,每月飞回家一趟,太累,睡眠成问题,工作效率不如以往,她等着麻省那边安排新活。Mitchell往Langley回电邮,他想介绍李去另外一个州做系统组合(Integration)工作,李想回家,再说系统组合工作不适合李。李在Langley的顶头上司直接找到Anna Selwyn,Anna把李安排到Charlers Harbour部门的气象雷达组,李逃出了Michell的部门。
2004年元月,李回到麻省开始工作。一天下午在办公楼外,Jen往外走,李往里走,两人狭路相逢。Jen朝李走了几步停下来,俩人相距4到5尺,李抬手想打招呼,突然发现Jen恶狠狠地瞪着她,李加快脚步走掉了。李回到楼里有点心慌,她给同办公室的越南女孩Ha Do发个电邮(Ha不在办公室),李说Jen如此漂亮如此可怕。发完电邮,李才感到平静一些。从此以后,无论何时何地碰到Jen,只要旁边无人,Jen就表演瞪眼功,李就鞋底摸油,溜。如此这般平均一个月一回合地持续着。
李碰到Buliung总想问他调查结果,Buliung总说忙。终于有一天Buliung说有空,李来到他的办公室,却见Buliung在打电话,李回到自己的办公室,20分钟之后再去见Buliung,他还在打电话。李只好放弃,打消了询问调查结果的念头。
四月份,公司作调整,Charlers Harbour的部门合并到Michell的部门,李又回到Michell管辖范围,而且气象雷达组的活也要完了,李又要找新工作。李的顶头上司 Scott Ogle牛y忙活了一阵,没有结果,他开始要李自己去找工作。Ogle牛y开始旁敲侧击要李出去找工作,他说李应该走了,李应该离开雷神,李和Jen有矛盾,李没有政审资格无法做军方项目等等。李答应Ogle牛y可以出去找工作。到五月份,Mitchell给Ogle牛y一个电邮,要李考虑去马里兰州工作。李告诉Ogle牛y如果要她离开家她会失眠,Ogle牛y有点发急,他说公司要裁人李在名单上。李说好吧,李试着申请马里兰的工作,谁知连这份工作也要政审资格,李很泄气。
李发现公司的ERAM项目并不需要政审资格,很多人都往ERAM跑,连那些有政审资格的人也往ERAM跑。李注意到公司并没有裁人谣言,那些当年从欧洲,加拿大和澳大利亚来的总共20多人,包括Mitchell在内,都没有政审资格,单单李一个人被告知出去找工作。李自己找到ERAM的负责人Guy Germana和Jerry Griep,四天后,他们给李安排了一份工作。Germana感到奇怪,他对Ogle牛y说“李怎么会找不到工作”。
李开始怀疑 Michell和Ogle牛y的意图,李于六月一日给Buliung发电邮告知Ogle牛y赶她走的事,Buliung不理睬。李给Mitchell和 Michell的上司Maryann King同时发电邮,Maryann 回话责怪李没有政审难找工作,Michell说他就要找ERAM项目经理谈。
六月二十一号ERAM工作开始,李搬进三号办公楼。Jen也在三号楼,机会多了,瞪眼行为上升到平均一月两次。但是Jen好像越发狠了,瞪的更可怕了。李开始考虑人身安全。
七月十七,李向雷神亚太协会发电邮反应Michell撵她走的事。亚太协会头目之一唐(Ed Tang)把电邮转给Maryann。七月二十七,Maryann和Buling找李谈话,为了缓和气氛,说可以请个中国雇员旁观,Maryann还问李是否考虑隐私,李说她担负不起隐私,坚决要求中国雇员旁观。刘(William Liu)被请来。Maryann和Buling并没有告诉李裁人谣言真假的问题,他们还是强调政审资格问题,Maryann还说是Mitchell给李安排的ERAM的工作,李只觉滑稽,谈话就算过去。
两天后,也就是七月二十九日,Ogle牛y在楼道里碰到李,他问李给Maryann 的电邮说了什么,李说你干嘛不问Mitchell,Ogle牛y说Mitchell也不让知道。李说她把Ogle牛y说的话都回报上去了,比如“你应该走了,你和Jen有矛盾”,Ogle牛y说是啊他确实说过。李说还有“公司要裁人,你在名单上”,Ogle牛y笑了,他说“不,我从来没说过,你无法证实,其实根本没有裁人这回事”。李吃了一惊,还没有反应过来,Ogle牛y又说“等Jen当上软件中心经理,你就有麻烦了”,李说“克林顿作了总统, Paula Jones还是很安全的”,Ogle牛y说“Shame”,李感到恐惧,李想到这些天Jen总是恶狠狠地瞪她,李说“请记住,如果我和我家人有任何意外,请不要相信那是事故,那可能是谋杀”,Ogle牛y笑着说“好,我记住了”。回到办公室,李想到光说不行,必须留下证据以防万一,李给Buliung发了电邮叙述了和Ogle牛y的谈话,专门提到“如果我和我家人有如何意外,请不要相信那是事故,那可能是‘谋杀’”,谋杀两字打引号,李主要害怕被人袭击,比如在停车场什么地方。为了防止Buliung删掉电邮不认帐,李假说此电邮也发给中国雇员了。
零四年八月三日,Buliung打电话要李去他的办公室见counselor John Didio,李以为counselor就是调查员,李很高兴,她很快去了。到了Buliung办公室,只见Buliung和Stephanie Kolenski在那里。Buliung手里拿着打印出的电邮问李“难道Jen Lewis对你有人身威胁吗”?李说“是的,她总瞪我”。就在这时,Didio来了,寒喧几句坐下来,Buliung和Stephanie站起来准备走,李不愿和男的独处,李让他们留下来了。Didio拿出一个保密表格要李签字,李一听“保密”两字就害怕,李不但不签,还说“保密很肮脏”。Didio感到不好说话,他出其不意直接问“你想杀人吗”?李很奇怪“你是说有人要杀我”?Didio说“不,我是说你,你想杀人吗”?李很生气“这个问题你应该问他们”。Didio斜眯着眼看着李,突然用手指着李问“你想要。。。,你想要。。。”,每问一个“你想要。。。”就用手指一下李,并且逼视着李好像恶兽见到食物。刹那间,李受到极度惊吓,好像被强奸了,她极其愤怒地说“停下来,我是受害者”。Didio手还不停,李说“我不想和你说话”。Buliung止住Didio,Didio站起来准备出去,他还不甘心,出门前他拿了一叠纸问李是否能回答这些问题,然后把答案交给他,李感到恐惧,她拒绝了。Didio走后,李无法平息愤怒, Stephanie试图安慰她,Buliung问了一些Jen瞪眼的事,才几分钟,Didio又回来了,又坐在原处。Buliung用汇报的口气对 Didio说了Jen瞪眼的事,Didio用坐大的口气说“那就找Jen谈话”。然后问李什么时候第一次瞪眼。话题从瞪眼说到那个女子数据库组,李说她们一直对李不公平,不过李已经不在乎了,Didio似乎抓住了话柄“什么,你不在乎她们对你不公平”?李厌恶极了,她把头扭向一边不再理会Didio。 Buliung又制止了Didio,Didio准备出门,他又不甘心地问李能不能约个时间再谈,李感到恶性,她拒绝了。Didio走后,李说Didio骚扰(insult)她,Buliung说如果Jen看到李的电邮会怎么想,李说“可能一样,但那电邮(担心自身安全)是我的真实感受”,这时李突然领悟到了Buliung对Jen的个人爱护,Jen太美了,Buliung不过是拿Didio当枪使。走出Buliung的办公室,李只觉天旋地转,不知道下午是如何过的,只记得开车回家极其危险,那车忽而左要撞对面的车,忽而右要撞到路边石头。
李开始做恶梦,夜夜数次惊醒,Didio的奸笑和手指经常浮现在眼前,即使白天也无法控制情绪,她开始摔东西嚎叫,家里乱作一团。李的先生是个老实人,只知道唉声叹气,却想不出办法,况且他也在 Ogle牛y的组里工作,由此可见西风不识相,老美打狗是不看主人的,因为中国人就不是人。
李虽然不懂她已患上精神创伤综合症,但是她知道Didio对她进行了极大伤害,她必须极快说出去,否则无人知晓真相。
八月八日,一个星期天,李窜回公司向雷神亚太协会百人网发电邮,她说“上星期,Buliung要我去人事部见John Didio,说是机密谈话,尽管我拒绝任何机密事务,他们还是进行。突然Didio问‘你是不是要杀人’,并且用下流的眼光瞪着我,。。。,事实是他们用令人恶性的问话骚扰(insult)无助的少数族裔女性,而没有任何亚裔旁观者。请问有何公司条例支持或反对这种骚扰行径?”
八月九日,李收到许多电邮和电话留言,都是亚太协会会员,他们非常震惊并询问发生何事。李还没有来得及解释,Buliung打来电话要李去他的办公室。李接受教训坚决不去Buliung的办公室,她要求在公共场所见面。因此,李,Buliung 和Stephanie来到餐厅见面。Buliung说李不能用公司电邮反映个人事情,李感到Buliung这人是多么残忍,李说“为什么Didio问我是否要杀人?” Buliung说“因为那个电邮,我们担心你的安全。” Stephanie说“他没有问你是否要杀人”,李说“他问了你是否要杀人”,Stephanie又说“他没有问你是否要杀人”,李又说“但是他问了‘你是否要杀人’”,Stephanie说“他问的是‘你是要杀别人还是要杀自己’”, 李说”我们应该录下来”。李心理总算明白了Didio的“你想要… 你想要… (Do you want to … do you want to …)” 原来就是“你是要杀别人还是要杀你自己”。Buliung抱怨他的电话不停,总有人询问发生何事,真是多管闲事,他要李不要用公司电邮,谈话到此结束。回到办公室,李发现Buliung已经迫不及待给亚太协会发了电邮,他声称“这个问题已经解决了”,他要求大家不要用公司电邮办“个人事情”。亚太头头 Cheryl Biagini也接着说若是有谁想用亚太协会发布消息先要请她过目。李明白Buliung是要隐瞒真相。
李休了几天假希望心情好一些。回来工作后照样置身于闪回状态,可是办公室里不能摔东西或嚎叫,她只能靠电邮发泄。既然不让用亚太协会百人网,那就告到公司道德部,李特别说明希望亚裔雇员参与调查,如果有人想找李谈话,要有亚裔雇员旁观。
八月二十六日,软件中心经理Maryann King,Buliung,和Stephanie要李开会,并请了中国雇员Ed Tang(唐)参加。会上,李问Maryann为什么Ogle牛y说公司要裁人李在名单上,Maryann说是有一个什么名单,李恐怕就在名单上,李又问那为什么Ogle牛y又否认他说过要裁人,还没等Maryann回到,Buliung插嘴说李会成为一个好律师;李又问为什么Jen总瞪她, Maryann说她准备找Jen谈话,就在这时,Stephanie突然问有没有人看见Jen瞪眼的事,李说没有人,因为Jen只在没人的时候才瞪她;李觉得奇怪为什么Buliung坐在那儿不亢声,从八月三日李第一次汇报瞪眼事件到现在已经二十多天,Buliung可从来没有提过这事,难道Jen否认了吗?李心往下沉。会议的主题是要李忘掉过去向前看,以及不要再发电邮之类,Buliung还说他担心李在停车场出车祸,李刚要问明白,Buliung又说他担心李被汽车撞着。
回到办公室,李收到道德部Tim Schultz的电邮,Tim说无人指责李要杀人,Didio的意识是李“是否有想法要伤害(hurt)自己或他人”,李感到很难和道德部沟通,李回电说“‘你是否要杀人’与‘你是要杀别人还是要杀自己’有什么区别?”道德部不再理会。
八月二十七日,李去了Maryann的办公室,这也是唯一一次李去Maryann的办公室。李问为什么Didio拿李当潜在杀人者,Maryann说是“因为那个电邮”。李说“你知道吗,Didio的问话让我想自杀”,Maryann回答“这不是故意的”,她仍旧要求李忘掉过去向前看。
八月二十七日,李收到唐的电邮,唐说“听Marlborough那边传来话说你有笑脸了,大家都很高兴,希望你保持下去。”
李天天受煎熬,她把所有精力都放到工作上希望藉以解脱。到八月三十日,李忍无可忍,她豁出去直接给雷神总裁发电邮。李指出“我想呐喊,这是慢性谋杀: John Didio用其职业手段对我做精神折磨,他把一个受害者当作潜在杀人犯,这是最恶行径。目前我正坐在办公室里,但是很多时候我想呐喊!”
八月三十一日,李收到总裁Bill Swanson的回复“我委派Ken Peden找人和你谈,我听说这是上星期发生的。谋杀这词太具煽动性,这个问题要尽快解决。你的电邮今天就有会回答。”
午饭后,Stephanie来找李,她们到了人事部办公室外,李不想进去,李问有没有中国雇员作陪,他们说暂时找不到,人事部经理Paul Clegg喊李进去。一进门,李只觉天旋地传,淹没于恐惧中,浑身乏力差点倒下,她缩到墙角用手撑着墙开始哭泣,Stephanie赶紧把门关上,李更觉恐怖,Stephanie要李坐下并端来一杯水。李说“我们中国人怎么了,我们中国人努力工作,拿钱又少。。。” 这时一个人走上来,李问“你是Ken Peden?”那人说他是John Didio的老板叫Irvin Kooris,李很愤怒,李说“John Didio为什么这么邪恶?他为什么把人变成动物?他为什么要问我‘你是不是要杀人’?”李一边说一边模仿Didio的样子用手指着Kooris, Clegg回答说“是因为那个电邮!”李说“我可以把那个电邮公布出去,我不担心,他们却会担心。” Clegg给李一封信,他说因为李不听劝告用公司电邮讲个人事情,给总裁发电邮,公司决定让李带薪留职,去见医生做评估,能否回来上班,要看医生报告。李要求必须是说普通话的医生,他们答应了,但必须是Kooris推荐的医生。然后Stephanie陪李回去收拾东西,李把工作证交给Stephanie之后离开公司,从此以后再也没有去上班。
李不知如何把车开回家的,千幸万幸没有出事故,从此以后度日如年。李的先生回家一趟,安顿下来又匆匆回去上班,人在屋檐下,他也没有办法。李并不知道应该立即看自己的医生,她担心的还是保住工作。Kooris先是安排了一个说普通话的心理学家,不知何故这心理学家又不干了。Kooris只好找了一个在麻省总医院做精神病理医生的美国人。李担心公司和医生合伙编造李有精神病要杀人,李向Kooris 要Didio的谈话记录,Kooris说对于2003年的谈话Didio没有发现任何问题,对于零四年八月的谈话,由于李发火了,谈话没有结果。 Kooris并没有告诉李Didio有谈话记录,李也不知道Didio是有执照的社工,即使知道Didio是社工,李也不知道社工是干什么的,更不知道做记录是社工的职责。
十月四日,公司让李停薪留职。Clegg给李打电话时,Buliung也说了一声Hello,李直感到恶性。下午,李打电话给Clegg要求不再让Buliung参与李的事务,李说Buliung对Jen有好感(crash on),Buliung做事不可能公平。Clegg问为什么李不早汇报Buliung有问题,李说中国人在公司不认识人也没有渠道向上反映,李说她根本不知道Clegg是Buliung的经理。
十月七号,李还是去见了Kooris找的医生Julia Reade。谈话前,李问Reade能否把评估报告给李一份,Reade说这报告是雷神出钱,李只能向雷神要,李又打电话问自己的律师,律师说如果医生认为李无病,就没有必要要这份报告,如果医生认为李有病而公司又不给,那就是一个强案。面谈中,Reade问李是否要杀人,李很愤怒,李说她要通过法律途径解决这些问题。Reade问李是否要自杀,李明白如果告诉医生想自杀,李就会被强行送进医院,李就会被当作精神病患者而失去为自己辩护的权力,因此李断然否认自杀念头。
Kooris当天就收到Reade的报告,他告诉李这报告太简单,李问他医生说什么,他说看不出来,他要李允许Reade写一个详细报告,李同意了。
十月二十六日,Kooris收到Reade的详细报告,他还是不让李知道医生的结论,他说他们要讨论。又过两天,公司通过李的律师传话说要李十一月一日回去上班,律师说看来医生认为李可以上班。但是李明白自己无法上班,因为她总是处于闪回状态。李要求自愿被裁,公司于十一月九日要求李签署一个放弃权力起诉公司的字据,李无法预知未来而拒绝了。同时,李自己的医生开始为李申请短期病休。
十一月十八日,公司总算同意给李的家庭医生一份Reade报告。几天后,李向自己的医生(是个美国人)索要Reade报告,李被告知这份报告属于雷神,李只有向雷神索要,李无限沮丧。不过李认为Reade诊断李可以工作,也就没有必要再去索取。李也不再聘用律师,已经。
十一月三十日,Stephanie给李一封信,她说由于保险公司MetLife拒绝了李的病休申请,李应该在六天后回去上班,否则就开除李。李打电话问 MetLife才知道他们没有收到任何医生报告。李又打电话告诉Stephanie她不能上班,李希望公司给她时间申请病休,Stephanie说“我不管,这是公司规定。”李很气愤,李问“难道不考虑安全问题,如果我要杀你呢?”Stephanie说“你能否重述?”李问“你要录音吗?”李说她要向 Ken Peden汇报,这不公平。随后李给Ken Peden发电邮抗议Stephanie的信,Peden没有回应。
十二月七日,Stephanie发信告知李12个星期的家庭病休(Family Medical Leave Act)就要在十二月底结束,李若不能回去上班,公司就要终结雇用关系。李把医生的信寄给Stephanie,信中说明李需要休息半年。
2005 年一月,保险公司通过李的短期病休。当MetLife代理人Ken Lemelle告诉李他们收到了Reade医生报告,李开始发懵,李问“Reade医生说什么”,Lemelle说“Reade说你不能工作”。李的头轰的一下,李说“不对呀,他们收到Reade报告的时候是要我回去工作的。你看,他们总是撒谎!”Lemelle也奇怪“这么说你是可以工作的嘛,你等等,让我再去问他们。”李说“对了,你问清楚了告诉我。”李没想到公司竟然如此邪恶,连医生报告也藏。李再次受到打击,精神状况进一步恶化,李开始用强力镇静药,开始申请长期病休。
一月十七日,公司结束了李的雇用关系,理由是12个星期的短期病休过了,李又不能回来上班。李只好把她和她女儿的医疗保险转到她先生账下。
一月底,李发电邮给Keden和雷神亚太协会,抗议公司隐瞒医生报告,公司无人理会。李接受教训把医生都换成中国人,又向公司要求把Reade报告转送给李的两个中国医生,公司无人理会。
二月份,李向公司申请工伤赔偿,原因是精神创伤无法工作,公司拒绝。此案自动转到工业部的工伤部。李把她与雷神公司工伤部分析员Frank Ruel的电邮发向公司几百号人,公司乱了一阵。有中国雇员问李是不是李的“那个电邮”说了什么才召至Didio审问“你是否要杀人”,李认识到她必须公开“那个电邮”。
三月十六日,李又向公司发电邮,她详细描述Didio的审讯过程,并公布了“那个电邮。” 很久以后李才知道Buliung很快离开了雷神。
李并不懂如何上告公司歧视,几经周折才知道有个公平就业委员会EEOC。李结结巴巴写了一页半的歧视报告,于四月二十一日交到EEOC,EEOC自动转告麻省反歧视委员会MCAD。
五月二十日,雷神公司恢复李的病休状态,理由是保险公司在四月份通过了李的长期病休,按照公司规定,长期病休可以维持两年雇用关系。李认为主要原因是李告到了EEOC。
六月份,雷神公司向EEOC提议要李回公司参加仲调,李想到John Didio不就是公司请来的第三者吗,公司出钱请的仲调能公平吗?李坚决拒绝。
八月份,EEOC认为雷神已经恢复了李的病休状态,歧视不成立,结案。李到EEOC要了所有文件,包括公司提供的材料。李发现了2002年Mattie Ervin的秘密报告,原来Mattie专门从那些整李的人那儿收集负面资料,这些人说李个性强固执造成工作纠纷,Mattie根本不考虑李的同事 William Kerr的电邮指出李受到不公平待遇。在EEOC,李意外地碰到一个在那儿工作的中国人,Ken An (安先生),安告诉李九十天内必须上告联邦法院,不要等待MCAD的调查结果,否则有效期就会过去。
上告岂是易事,李不懂法律,英语又差。李一直在找律师,没有人愿意不收钱接这个案子。时不我待,李从互联网找了一个他人的歧视上告书(Complaint),就比葫芦画瓢写出自己的上告书,距最后期限还差两天,也就是2005年十月七日把雷神公司告上联邦法庭。李以联邦反歧视法第七条(Title VII)告雷神公司种族歧视和报复,以普通侵权法(Common Tort Law)中的以权谋私条例(Tortious Interference with Advantage Relationship)告部门经理Mr. Mitchell和人事部官员Mr. Buliung,以普通侵权法中的故意精神伤害条例(Intentional Infliction of Emotional Distress)告Mr. Buliung,又以普通侵权法中的欺骗条例(Misrepresentation & Deceit)告雷神公司隐瞒医生报告。
2005年底,李索取到了公司的个人党案袋(personnel file),李发现Buliung在所有记录中都把Didio的问题“你是否要杀(kill)人”改成“你是否要害(harm)人”,由此淡化Didio 的邪恶。不过Stephanie在公司内部调查时说她“感到李受到白人男性的人身威胁,这在开会时很明显(Stephanie felt that Yong was physically intimidated by white males, it was evident in the meeting with her)”。
其后,李又发现麻省自己还有反歧视法151B,李发动议要求把151B补充进去。谁知联邦法院正处于从邮政文件向电子文件转型期,工作混乱。律师们本来就有法院的电子账号,他们根本不用邮局寄信件。李不是律师,花了两个月才申请到账号。不管是谁的责任,反正李没有收到邮局寄出的法令,十四天一过,法官就不允许李补充151B条例。李不甘心失去法律赋予的权力,她跑到麻省州立法院另辟战场,专告 151B,并附告John Didio违法操作(Malpractice)侵犯李的照会权(Right of Consent)和故意精神伤害。
经历了一年多的预审调查取证 以及李 和被告律师之间无休止地扯皮发动议与反动议之后,联邦法官Richard G. Stearns在没有涉入任何具体事实的情况下,不安排听证,不提供口头辩论的机会,而是直接采纳雷神公司提出的动议(Motion)在2006年底进行总结评判(Summary Judgment)。按说总结评判应该以被动方(Nonmoving Party)李提供的事实(Facts)为依据,谁知道法官Stearns却以主动方(Moving Party)雷神公司提出的结论(Conclusion)为依据,草草断案(Enter Judgment)认为歧视和报复不成立。其判词一页纸,没有事实分析,没有法理解释。如此判决真如葫芦僧判葫芦案,荒唐至极,终其原因是因为李是一个 pro se,即没有律师全凭自己打官司。法官都不喜欢pro se,只愿意和律师打交道,而李又请不起律师。李向法院内部纪律检查委员会举报法官Stearns歧视pro se,李只想给Stearns留个记录而已。
李来到第一巡回法院开始了上诉行程,这回李有点经验了,她发动议要求三人法官组详细审查案情,并暗示若不公平就告法官。法官也怕告,坏记录多了影响升迁。
2007 年九月,巡回法院维持原判,其判决书好几页纸,专门提到因为李2002年告Jen Lewis,2004年才挨整,两年时间太长,消除了因果关系,报复不成立。这是一个大破绽,感谢岳东晓博士,他指出此判决与第六巡回法院和第九巡回法院的判决相矛盾,时间长并不能消除因果关系,原因是李在佛州(Virginia)呆了一年,那些人无机会报复,等李一回到麻省,报复立即开始。第九巡回法院曾经判了一个十年因果关系成立的报复案,原因是十年期间报复者没有机会,一旦受害者回到报复者手下干活,报复立即开始。此案已经造成巡回法院分裂,李要求七人法官团(En Banc)复审。
李还提出要求复审是否“发现原理”(Discovery Rule)可用于第七条,这是因为Mitchell和Ogle牛y散布裁人谎言要李离开公司的事发生在有效期之前(从李告到EEOC的前300天算起,即 2004年六月二十五日以前发生的事件不考虑),但是它发生时李并不知道那是报复。直到Ogle牛y在2004年七月二十九日否认他的裁人谎言时李才明白,按照发现原理,报复指控应该从发现那天算起,因此它不算过期。发现原理从来没有用于第七条,联邦最高法院允许自由争辩。目前李在等待七人法官团的判决,下一个目标是联邦最高法院。
李的工伤赔偿案已在2007年六月被据。工伤赔偿法官(Administrative Judge)William Constantino不接受法院法医的报告,其指出李的精神伤害是公司造成的。法官只接受雷神请的Reade医生的观点,Reade医生引用 Mattie的秘密报告,那就是李性格有毛病,李个性强,固执,因此造成工作纠纷。Reade医生不重视瞪眼之事,不提Didio的审问,她认为李担心个人安全纯属幻觉,她得出结论李的精神伤害不可能是公司造成的。李的律师也没有争论李的性格问题,其实李的年鉴说“李待人友好,容易相处”, Stephanie在人事部的记录也说李从不与人冲突(she was never confrontational)。法官还接受Buliung, Stephanie 和Didio的谎言“你是否要害人”,不接受李的证词“你是否要杀人”, 法官判Didio的问话不会惊动任何人(Mr. Didio spoke in a way that would not alarm anyone),他认为Didio没有故意骚扰,也没有骚扰李(I find that Mr. Didio did not intent to harass Ms. Li, nor did he harass Ms. Li),李自己胡涂了(but she was confused)。法官给的唯一面子就是承认了Jen Lewis的瞪眼事件。李的律师正在抓住这连续八个月的瞪眼事件做上诉。
由于联邦法官Stearns拒绝受理李的普通侵权条例,李的州立法院的案子还在进行。

李永告雷神 (Yong Li v. Raytheon)完整版
李永(“李”)是软件工程师,在中国完成两个学位。她于90年随夫去英国,先后在三家不同的公司搞软件开发。她于1998年初被雷神公司招聘到美国麻省Marlborough市做导航系统控制开发。
雷神公司是美国第三大军火财团,位于Lockheed Martin 和波音 Boeing 之后,以造导弹为主,其雷达导航业务面向全球,是一个拥有年营业额200亿美元($20B)的跨国公司。
进雷神工作之后,李发现阿毛阿狗都在搞软件。李所在的数据库开发组大都是女的,组长Gayle McEleney只拥有法国文学学位,在公司混了二十多年以写文件为主,借着九十年代经济泡沫,各软件组空有合同,无人开发的当口进了数据库组并做了组长。本来麻,技术上不行,做领导未必不可。但是这个Gayle特别喜欢修改李的程序,这也是她学习软件的法子,再简单的程序只要她看不懂,就要李重写,于是滑稽的事来了。Gayle看不懂李写的条件语句:

她认为条件A和条件B在一起不容易懂,要李重写。李认为没有必要改,于是把如果(if)和此外(else)颠倒一下就准备糊弄过去。谁知25岁的小组长Belinda Gunn认真贯彻执行领导意图,她非常聪明地把程序改为:

然后Belinda要求李按此逻辑修改十一个类似的数据窗口。李和Belinda用电邮讨论了两个来回,Belinda固执己见,李就把这个电邮发向几个组员请大家讨论。组长Gayle不懂装懂回了电邮表达了她的两美分(two cents),她说Belinda改错改的好(也不知道错在哪),Belinda是小组长有权做决定。看不贯Gayle的蛮横,借调来的组员Conall McGleenan回应了爱尔兰两便士 (Conall是暂时从爱尔兰借调来的,他拥有工程博士学位),他指出条件(if)语句不用分,而且Belinda的程序造成不必要的重复,如果有谁看不懂,加一句注释行就行了。一看有人替李说话,新上任的经理Jen Lewis登场了。
Jen Lewis 是个极其美艳又雄心勃勃的女性。正好雷神公司提倡多元化,总有一定名额的经理位子留给少数族裔。Jen 作为白人女性,也就顺理成章成了少数族裔里的特权阶层。确实,自从李来美,软件中心实验室总头的高位换了好几个,全是白人女性。Jen 刚出道,想做实验室经理恐怕还要熬上很多年,但是已经有人说俏皮话作预言了。李在2000年曾经在气象雷达组为Jen工作过两月,那时Jen还不是经理,感觉Jen很聪明,工作积极主动,一看就知道是准备当官的。果然Jen很快做了经理并兼管数据库这一滩。本来李和Jen的关系不错,只是李有一次试图跳槽到另外一个经理Waseem Naqvi那儿工作没有成功,问题就来了。Jen从此之后对李的态度就变了,无论组里有何争论,Jen总是反对李。这一次居然有重量级的Conall替李说话,那怎么行。Jen 赶紧召集午饭后会议,希望大家支持小组长Belinda。另外一个组长Shari Sewell (这个组官比兵多)在会上说她不做判断谁的程序好,她说了隐私问题,认为讨论应该只限于李和Belinda之间。李当场问Jen谁的程序好,Jen说她不做判断谁的程序好。李提出请Waseem和另一个高级工程师Mark Edry做决定,Jen说不,她说Belinda是组长应该说了算。Jen 希望大家支持Belinda, 谁知Conall, William Kerr和 Ian Johnson 全都为李说话,反对Belinda的程序。Jen气坏了,她把这三个男的撵出会议室。无人替李说话,Jen就变了,她狠狠地对李说李用这总技术讨论打击组长。李没有反应过来打击(attack)这个词,李的英语并不是那么好,但是她感觉到了Jen的可怕,有点要打架的感觉,李能感到Belinda 脸也变了,Belinda有点吃惊。李说人是平等的,李说如果Belinda坚持要改,李可以改。Belinda很难过,她认为她的程序好。会议不了了之。
回到办公室,李发现高级工程师Mark Edry(MIT毕业)也回了电邮,他说李的程序更易懂,并指出俩人思路不同。这当然是马后炮,谁也改变不了Jen的决心,那就是顺我者昌,逆我者亡。到了快下班的时候,Belinda发了一个电邮要求改程序,李回问到底改成谁的,Belinda说改成她的,李说没问题。于是十一个窗口都改成如果(if)套如果的笨语句。
第二天,李心有余悸试图改善关系,她碰到Jen就说真没想到Belinda这样脆弱,真对不起Belinda,Jen反而又硬了,她说李把电邮发出去对Belinda不公平,她可从来也不想是否对李公平。
可能是上面察觉到了什么,李的行政经理(section manager)Tony Casieri很快把李调到别的组。Tony很快也被Jeffery Wilson取代。Jen对Tony没有影响力,对Jeff可以说是自家人,他们都属于德国项目P1的核心圈子,实权派。李在别的项目干活,如果还待在Jeff的行政部就不是好事。李曾经对Jeff提过Belinda改程序的事,Jeff说如果组里开会大家作决定要改那就应该改。李说什么大家,就是Gayle一个人决定。Jeff说李若不同意Gayle的决定应该当场提嘛,李说提也没用,Gayle就不懂。
到年底,Anna Selwyn 把李调到自己的行政部,从此应该彻底摆脱Jen的阴影。谁知过了年雷神公司开始作上一年度总结鉴定的时候,问题又来了。
2002年一月,Anna 把鉴定初稿交给李,李一看竟然有一条说李在数据库组工作的时候不尊重领导。李留了个心眼,她把同事William Kerr(借调的爱尔兰工程师)的电邮呈给Anna,电邮说William和Conall一来数据库组就发现李受到不公平待遇。见有物证,Anna说她再查查。李还不放心,她赶紧同回到爱尔兰的Conall联系,请他向Anna解释数据库组发生的事,Conall回复说除非Anna询问他,否则不符合规则。也不知道Anna都作了些什么,反证她把“不尊重领导”这一条去掉了,并加上一条李在数据库组“贡献重大”。李没有想到Jen居然试图在鉴定上作手脚,李向Anna提出Jen应该向李道歉,Anna说Jen将来要在雷神公司爬到很高的位子,如果向Jen索取道歉,李就会树立一个强敌。李离开Marlborough来到邻镇Sudbury分部工作。
新年一过,各种培训也展开了,每年一度的道德培训又开始走过场。这一回李不再漫不经心,她认真听取人事部的上访渠道,决定把Jen的事情反应上去以免后患。李找到雷神亚太协会头头康(Richard Kung),康要李见雷神的公平就业办公室EEO经理Steve King。三月分,李拿着那个所谓打击Belinda的电邮讨论去见Steve,Steve听了来意,说这是去年夏天发生的事,太晚了,以后有事立即来找他。
十月份,公司丢了几个合同,裁人的流言开始漫传。李认为这一回一旦被裁,Jen Lewis的事就再也没有机会提了。因此李写了一个上告文,把在数据库组发生的事简单叙述一下,指明Jen对李不好就因为李是中国人。EEO的Steve委派Mattie Ervin做调查。裁人已经开始,EEO被砍,Mattie已经离开麻省到佛州(Virginia)的雷神分部,她只能通过电话做调查,然后告诉李歧视指控不成立。李要求看调查被告,Mattie说给人事部的Megan Turley了。李找到Megan,Megan不给,李坚持要一个书面结果,Megan就写了半页空洞的信打发李。李又向公司道德部索要Mattie调查报告,道德部官员Tim Shultz说是要保护被调查者隐私,不能给李看报告,甚至连被调查者名字都不能说。李从Mattie那儿能得知Conall和William并没有被调查,李认为调查不公平。
过了年(2003),Megan不耐烦李的纠缠,她要李去见公司的Counselor John Didio谈。李就向Didio索要报告,Didio问了李一大堆泛泛的问题,诸如来美多少年阿,对美国感觉如何,家里有多少人阿等等。李向他要报告,Didio说Megan管报告,如果她不给这事就不成,李只有找律师想办法。李问Didio能否介绍律师,Didio说他是为公司办事,不能为李介绍律师。
二月份,李将要被外派到佛州美国航天部NASA的Langley研究中心工作。临走前,李在走廊上碰到人事部经理Arthur Buliung。Buliung是个和蔼的小老头,很容易说话,他答应就李的事再向Conall和William做调查。
七月份,李在Langley收到Buliung电话,他说他问过Conall,Conall说的和别人没有两样。William不回电话,Buliung也没有办法。李要求Buliung把调查结果电邮过来,Buliung回了一个短邮说等李回到麻省会当面谈。
十月份,Jen Lewis的好友Ian Mitchell在麻省被提升为部门经理,管理着上百号人,并兼管外派到Langley的几个人。Mitchell是苏格兰人,比李早一年从英国招到雷神。同是新移民,Mitchell得天独厚,苏格兰口音在英国不吃香,在美国很牛,特有的英国幽默使Mitchell在雷神公司如鱼得水。Mitchell意气风发,和Jen Lewis同办公室几年后,就般进了带窗户的经理办公室。
十一月份,Langley的工作要完了。李和家人两地分居,每月飞回家一趟,太累,睡眠成问题,工作效率不如以往,她等着麻省那边安排新活。Mitchell往Langley回电邮,他想介绍李去另外一个州做系统组合(Integration)工作,李想回家,再说系统组合工作不适合李。李在Langley的顶头上司直接找到Anna Selwyn,Anna把李安排到Charlers Harbour部门的气象雷达组,李逃出了Michell的部门。
2004年元月,李回到麻省开始工作。一天下午在办公楼外,Jen往外走,李往里走,两人狭路相逢。Jen朝李走了几步停下来,俩人相距4到5尺,李抬手想打招呼,突然发现Jen恶狠狠地瞪着她,李加快脚步走掉了。李回到楼里有点心慌,她给同办公室的越南女孩Ha Do发个电邮(Ha不在办公室),李说Jen如此漂亮如此可怕。发完电邮,李才感到平静一些。从此以后,无论何时何地碰到Jen,只要旁边无人,Jen就表演瞪眼功,李就鞋底摸油,溜。如此这般平均一个月一回合地持续着。
李碰到Buliung总想问他调查结果,Buliung总说忙。终于有一天Buliung说有空,李来到他的办公室,却见Buliung在打电话,李回到自己的办公室,20分钟之后再去见Buliung,他还在打电话。李只好放弃,打消了询问调查结果的念头。
四月份,公司作调整,Charlers Harbour的部门合并到Michell的部门,李又回到Michell管辖范围,而且气象雷达组的活也要完了,李又要找新工作。李的顶头上司Scott Ogle牛y忙活了一阵,没有结果,他开始要李自己去找工作。Ogle牛y开始旁敲侧击要李出去找工作,他说李应该走了,李应该离开雷神,李和Jen有矛盾,李没有政审资格无法做军方项目等等。李答应Ogle牛y可以出去找工作。到五月份,Mitchell给Ogle牛y一个电邮,要李考虑去马里兰州工作。李告诉Ogle牛y如果要她离开家她会失眠,Ogle牛y有点发急,他说公司要裁人李在名单上。李说好吧,李试着申请马里兰的工作,谁知连这份工作也要政审资格,李很泄气。
李发现公司的ERAM项目并不需要政审资格,很多人都往ERAM跑,连那些有政审资格的人也往ERAM跑。李注意到公司并没有裁人谣言,那些当年从欧洲,加拿大和澳大利亚来的总共20多人,包括Mitchell在内,都没有政审资格,单单李一个人被告知出去找工作。李自己找到ERAM的负责人Guy Germana和Jerry Griep,四天后,他们给李安排了一份工作。Germana感到奇怪,他对Ogle牛y说“李怎么会找不到工作”。
李开始怀疑Michell和Ogle牛y的意图,李于六月一日给Buliung发电邮告知Ogle牛y赶她走的事,Buliung不理睬。李给Mitchell和Michell的上司Maryann King同时发电邮,Maryann 回话责怪李没有政审难找工作,Michell说他就要找ERAM项目经理谈。
六月二十一号ERAM工作开始,李搬进三号办公楼。Jen也在三号楼,机会多了,瞪眼行为上升到平均一月两次。但是Jen好像越发狠了,瞪的更可怕了。李开始考虑人身安全。
七月十七,李向雷神亚太协会发电邮反应Michell撵她走的事。亚太协会头目之一唐(Ed Tang)把电邮转给Maryann。七月二十七,Maryann和Buling找李谈话,为了缓和气氛,说可以请个中国雇员旁观,Maryann还问李是否考虑隐私,李说她担负不起隐私,坚决要求中国雇员旁观。刘(William Liu)被请来。Maryann和Buling并没有告诉李裁人谣言真假的问题,他们还是强调政审资格问题,Maryann还说是Mitchell给李安排的ERAM的工作,李只觉滑稽,谈话就算过去。
两天后,也就是七月二十九日,Ogle牛y在楼道里碰到李,他问李给Maryann的电邮说了什么,李说你干嘛不问Mitchell,Ogle牛y说Mitchell也不让知道。李说她把Ogle牛y说的话都回报上去了,比如“你应该走了,你和Jen有矛盾”,Ogle牛y说是啊他确实说过。李说还有“公司要裁人,你在名单上”,Ogle牛y笑了,他说“不,我从来没说过,你无法证实,其实根本没有裁人这回事”。李吃了一惊,还没有反应过来,Ogle牛y又说“等Jen当上软件中心经理,你就有麻烦了”,李说“克林顿作了总统,Paula Jones还是很安全的”,Ogle牛y说“Shame”,李感到恐惧,李想到这些天Jen总是恶狠狠地瞪她,李说“请记住,如果我和我家人有任何意外,请不要相信那是事故,那可能是谋杀”,Ogle牛y笑着说“好,我记住了”。 回到办公室,李想到光说不行,必须留下证据以防万一,李给Buliung发了电邮叙述了和Ogle牛y的谈话,专门提到“如果我和我家人有如何意外,请不要相信那是事故,那可能是‘谋杀’”,谋杀两字打引号,李主要害怕被人袭击,比如在停车场什么地方。为了防止Buliung删掉电邮不认帐,李假说此电邮也发给中国雇员了。
零四年八月三日,Buliung打电话要李去他的办公室见counselor John Didio,李以为counselor就是调查员,李很高兴,她很快去了。到了Buliung办公室,只见Buliung和Stephanie Kolenski在那里。Buliung手里拿着打印出的电邮问李“难道Jen Lewis对你有人身威胁吗”? 李说“是的,她总瞪我”。就在这时,Didio来了,寒喧几句坐下来,Buliung和Stephanie站起来准备走,李不愿和男的独处,李让他们留下来了。Didio拿出一个保密表格要李签字,李一听“保密”两字就害怕,李不但不签,还说“保密很肮脏”。Didio感到不好说话,他出其不意直接问“你想杀人吗”?李很奇怪“你是说有人要杀我”?Didio说“不,我是说你,你想杀人吗”?李很生气“这个问题你应该问他们”。Didio斜眯着眼看着李,突然用手指着李问“你想要。。。,你想要。。。”,每问一个“你想要。。。”就用手指一下李,并且逼视着李好像恶兽见到食物。刹那间,李受到极度惊吓,好像被强奸了,她极其愤怒地说“停下来,我是受害者”。Didio手还不停,李说“我不想和你说话”。Buliung止住Didio,Didio站起来准备出去,他还不甘心,出门前他拿了一叠纸问李是否能回答这些问题,然后把答案交给他,李感到恐惧,她拒绝了。Didio走后,李无法平息愤怒,Stephanie试图安慰她,Buliung问了一些Jen瞪眼的事,才几分钟,Didio又回来了,又坐在原处。Buliung用汇报的口气对Didio说了Jen瞪眼的事,Didio用坐大的口气说“那就找Jen谈话”。然后问李什么时候第一次瞪眼。话题从瞪眼说到那个女子数据库组,李说她们一直对李不公平,不过李已经不在乎了,Didio似乎抓住了话柄“什么,你不在乎她们对你不公平”?李厌恶极了,她把头扭向一边不再理会Didio。Buliung又制止了Didio,Didio准备出门,他又不甘心地问李能不能约个时间再谈,李感到恶性,她拒绝了。Didio走后,李说Didio骚扰(insult)她,Buliung说如果Jen看到李的电邮会怎么想,李说“可能一样,但那电邮(担心自身安全)是我的真实感受”,这时李突然领悟到了Buliung对Jen的个人爱护,Jen太美了,Buliung不过是拿Didio当枪使。走出Buliung的办公室,李只觉天旋地转,不知道下午是如何过的,只记得开车回家极其危险,那车忽而左要撞对面的车,忽而右要撞到路边石头。
李开始做恶梦,夜夜数次惊醒,Didio的奸笑和手指经常浮现在眼前,即使白天也无法控制情绪,她开始摔东西嚎叫,家里乱作一团。李的先生是个老实人,只知道唉声叹气,却想不出办法,况且他也在Ogle牛y的组里工作,由此可见西风不识相,老美打狗是不看主人的,因为中国人就不是人。
李虽然不懂她已患上精神创伤综合症,但是她知道Didio对她进行了极大伤害,她必须极快说出去,否则无人知晓真相。
八月八日,一个星期天,李窜回公司向雷神亚太协会百人网发电邮,她说“上星期,Buliung要我去人事部见John Didio,说是机密谈话,尽管我拒绝任何机密事务,他们还是进行。突然Didio问‘你 是不是要杀人’,并且用下流的眼光瞪着我,。。。,事实是他们用令人恶性的问话骚扰(insult)无助的少数族裔女性,而没有任何亚裔旁观者。请问有何公司条例支持或反对这种骚扰行径?”
八月九日,李收到许多电邮和电话留言,都是亚太协会会员,他们非常震惊并询问发生何事。李还没有来得及解释,Buliung打来电话要李去他的办公室。李接受教训坚决不去Buliung的办公室,她要求在公共场所见面。因此,李,Buliung和Stephanie来到餐厅见面。Buliung说李不能用公司电邮反映个人事情,李感到Buliung这人是多么残忍,李说“为什么Didio问我是否要杀人?” Buliung说“因为那个电邮,我们担心你的安全。” Stephanie说“他没有问你是否要杀人”,李说“他问了你是否要杀人”,Stephanie又说“他没有问你是否要杀人”,李又说“但是他问了‘你是否要杀人’”,Stephanie说“他问的是‘你是要杀别人还是要杀自己’”, 李说”我们应该录下来”。李心理总算明白了Didio的“你想要… 你想要… (Do you want to … do you want to …)” 原来就是“你是要杀别人还是要杀你自己”。Buliung抱怨他的电话不停,总有人询问发生何事,真是多管闲事,他要李不要用公司电邮,谈话到此结束。回到办公室,李发现Buliung已经迫不及待给亚太协会发了电邮,他声称“这个问题已经解决了”,他要求大家不要用公司电邮办“个人事情”。亚太头头Cheryl Biagini也接着说若是有谁想用亚太协会发布消息先要请她过目。李明白Buliung是要隐瞒真相。
李休了几天假希望心情好一些。回来工作后照样置身于闪回状态,可是办公室里不能摔东西或嚎叫,她只能靠电邮发泄。既然不让用亚太协会百人网,那就告到公司道德部,李特别说明希望亚裔雇员参与调查,如果有人想找李谈话,要有亚裔雇员旁观。
八月二十六日,软件中心经理Maryann King,Buliung,和Stephanie要李开会,并请了中国雇员Ed Tang(唐)参加。会上,李问Maryann为什么Ogle牛y说公司要裁人李在名单上,Maryann说是有一个什么名单,李恐怕就在名单上,李又问那为什么Ogle牛y又否认他说过要裁人,还没等Maryann回到,Buliung插嘴说李会成为一个好律师;李又问为什么Jen总瞪她,Maryann说她准备找Jen谈话,就在这时,Stephanie突然问有没有人看见Jen瞪眼的事,李说没有人,因为Jen只在没人的时候才瞪她;李觉得奇怪为什么Buliung坐在那儿不亢声,从八月三日李第一次汇报瞪眼事件到现在已经二十多天,Buliung可从来没有提过这事,难道Jen否认了吗?李心往下沉。会议的主题是要李忘掉过去向前看,以及不要再发电邮之类,Buliung还说他担心李在停车场出车祸,李刚要问明白,Buliung又说他担心李被汽车撞着。
回到办公室,李收到道德部Tim Schultz的电邮,Tim说无人指责李要杀人,Didio的意识是李“是否有想法要伤害(hurt)自己或他人”,李感到很难和道德部沟通,李回电说“‘你是否要杀人’与‘你是要杀别人还是要杀自己’有什么区别?”道德部不再理会。
八月二十七日,李去了Maryann的办公室,这也是唯一一次李去Maryann的办公室。李问为什么Didio拿李当潜在杀人者,Maryann说是“因为那个电邮”。李说“你知道吗,Didio的问话让我想自杀”,Maryann回答“这不是故意的”,她仍旧要求李忘掉过去向前看。
八月二十七日,李收到唐的电邮,唐说“听Marlborough那边传来话说你有笑脸了,大家都很高兴,希望你保持下去。”
李天天受煎熬,她把所有精力都放到工作上希望藉以解脱。到八月三十日,李忍无可忍,她豁出去直接给雷神总裁发电邮。李指出“我想呐喊,这是慢性谋杀:John Didio用其职业手段对我做精神折磨,他把一个受害者当作潜在杀人犯,这是最恶行径。目前我正坐在办公室里,但是很多时候我想呐喊!”
八月三十一日,李收到总裁Bill Swanson的回复“我委派Ken Peden找人和你谈,我听说这是上星期发生的。谋杀这词太具煽动性,这个问题要尽快解决。你的电邮今天就有会回答。”
午饭后,Stephanie来找李,她们到了人事部办公室外,李不想进去,李问有没有中国雇员作陪,他们说暂时找不到,人事部经理Paul Clegg喊李进去。一进门,李只觉天旋地传,淹没于恐惧中,浑身乏力差点倒下,她缩到墙角用手撑着墙开始哭泣,Stephanie赶紧把门关上,李更觉恐怖,Stephanie要李坐下并端来一杯水。李说“我们中国人怎么了,我们中国人努力工作,拿钱又少。。。” 这时一个人走上来,李问“你是Ken Peden?”那人说他是John Didio的老板叫Irvin Kooris,李很愤怒,李说“John Didio为什么这么邪恶?他为什么把人变成动物?他为什么要问我‘你是不是要杀人’?”李一边说一边模仿Didio的样子用手指着Kooris,Clegg回答说“是因为那个电邮!”李说“我可以把那个电邮公布出去,我不担心,他们却会担心。” Clegg给李一封信,他说因为李不听劝告用公司电邮讲个人事情,给总裁发电邮,公司决定让李带薪留职,去见医生做评估,能否回来上班,要看医生报告。李要求必须是说普通话的医生,他们答应了,但必须是Kooris推荐的医生。然后Stephanie陪李回去收拾东西,李把工作证交给Stephanie之后离开公司,从此以后再也没有去上班。
李不知如何把车开回家的,千幸万幸没有出事故,从此以后度日如年。李的先生回家一趟,安顿下来又匆匆回去上班,人在屋檐下,他也没有办法。李并不知道应该立即看自己的医生,她担心的还是保住工作。Kooris先是安排了一个说普通话的心理学家,不知何故这心理学家又不干了。Kooris只好找了一个在麻省总医院做精神病理医生的美国人。李担心公司和医生合伙编造李有精神病要杀人,李向Kooris要Didio的谈话记录,Kooris说对于2003年的谈话Didio没有发现任何问题,对于零四年八月的谈话,由于李发火了,谈话没有结果。Kooris并没有告诉李Didio有谈话记录,李也不知道Didio是有执照的社工,即使知道Didio是社工,李也不知道社工是干什么的,更不知道做记录是社工的职责。
十月四日,公司让李停薪留职。Clegg给李打电话时,Buliung也说了一声Hello,李直感到恶性。下午,李打电话给Clegg要求不再让Buliung参与李的事务,李说Buliung对Jen有好感(crash on),Buliung做事不可能公平。Clegg问为什么李不早汇报Buliung有问题,李说中国人在公司不认识人也没有渠道向上反映,李说她根本不知道Clegg是Buliung的经理。
十月七号,李还是去见了Kooris找的医生Julia Reade。谈话前,李问Reade能否把评估报告给李一份,Reade说这报告是雷神出钱,李只能向雷神要,李又打电话问自己的律师,律师说如果医生认为李无病,就没有必要要这份报告,如果医生认为李有病而公司又不给,那就是一个强案。面谈中,Reade问李是否要杀人,李很愤怒,李说她要通过法律途径解决这些问题。Reade问李是否要自杀,李明白如果告诉医生想自杀,李就会被强行送进医院,李就会被当作精神病患者而失去为自己辩护的权力,因此李断然否认自杀念头。
Kooris当天就收到Reade的报告,他告诉李这报告太简单,李问他医生说什么,他说看不出来,他要李允许Reade写一个详细报告,李同意了。
十月二十六日,Kooris收到Reade的详细报告,他还是不让李知道医生的结论,他说他们要讨论。又过两天,公司通过李的律师传话说要李十一月一日回去上班,律师说看来医生认为李可以上班。但是李明白自己无法上班,因为她总是处于闪回状态。李要求自愿被裁,公司于十一月九日要求李签署一个放弃权力起诉公司的字据,李无法预知未来而拒绝了。同时,李自己的医生开始为李申请短期病休。
十一月十八日,公司总算同意给李的家庭医生一份Reade报告。几天后,李向自己的医生(是个美国人)索要Reade报告,李被告知这份报告属于雷神,李只有向雷神索要,李无限沮丧。不过李认为Reade诊断李可以工作,也就没有必要再去索取。李也不再聘用律师,已经。
十一月三十日,Stephanie给李一封信,她说由于保险公司MetLife拒绝了李的病休申请,李应该在六天后回去上班,否则就开除李。李打电话问MetLife才知道他们没有收到任何医生报告。李又打电话告诉Stephanie她不能上班,李希望公司给她时间申请病休,Stephanie说“我不管,这是公司规定。”李很气愤,李问“难道不考虑安全问题,如果我要杀你呢?”Stephanie说“你能否重述?”李问“你要录音吗?”李说她要向Ken Peden汇报,这不公平。随后李给Ken Peden发电邮抗议Stephanie的信,Peden没有回应。
十二月七日,Stephanie发信告知李12个星期的家庭病休(Family Medical Leave Act)就要在十二月底结束,李若不能回去上班,公司就要终结雇用关系。李把医生的信寄给Stephanie,信中说明李需要休息半年。
2005年一月,保险公司通过李的短期病休。当MetLife代理人Ken Lemelle告诉李他们收到了Reade医生报告,李开始发懵,李问“Reade医生说什么”,Lemelle说“Reade说你不能工作”。李的头轰的一下,李说“不对呀,他们收到Reade报告的时候是要我回去工作的。你看,他们总是撒谎!”Lemelle也奇怪“这么说你是可以工作的嘛,你等等,让我再去问他们。”李说“对了,你问清楚了告诉我。”李没想到公司竟然如此邪恶,连医生报告也藏。李再次受到打击,精神状况进一步恶化,李开始用强力镇静药,开始申请长期病休。
一月十七日,公司结束了李的雇用关系,理由是12个星期的短期病休过了,李又不能回来上班。李只好把她和她女儿的医疗保险转到她先生账下。
一月底,李发电邮给Keden和雷神亚太协会,抗议公司隐瞒医生报告,公司无人理会。李接受教训把医生都换成中国人,又向公司要求把Reade报告转送给李的两个中国医生,公司无人理会。
二月份,李向公司申请工伤赔偿,原因是精神创伤无法工作,公司拒绝。此案自动转到工业部的工伤部。李把她与雷神公司工伤部分析员Frank Ruel的电邮发向公司几百号人,公司乱了一阵。有中国雇员问李是不是李的“那个电邮”说了什么才召至Didio审问“你是否要杀人”,李认识到她必须公开“那个电邮”。
三月十六日,李又向公司发电邮,她详细描述Didio的审讯过程,并公布了“那个电邮。” 很久以后李才知道Buliung很快离开了雷神。
李并不懂如何上告公司歧视,几经周折才知道有个公平就业委员会EEOC。李结结巴巴写了一页半的歧视报告,于四月二十一日交到EEOC,EEOC自动转告麻省反歧视委员会MCAD。
五月二十日,雷神公司恢复李的病休状态,理由是保险公司在四月份通过了李的长期病休,按照公司规定,长期病休可以维持两年雇用关系。李认为主要原因是李告到了EEOC。
六月份,雷神公司向EEOC提议要李回公司参加仲调,李想到John Didio不就是公司请来的第三者吗,公司出钱请的仲调能公平吗?李坚决拒绝。
八月份,EEOC认为雷神已经恢复了李的病休状态,歧视不成立,结案。李到EEOC要了所有文件,包括公司提供的材料。李发现了2002年Mattie Ervin的秘密报告,原来Mattie专门从那些整李的人那儿收集负面资料,这些人说李个性强固执造成工作纠纷,Mattie根本不考虑李的同事William Kerr的电邮指出李受到不公平待遇。在EEOC,李意外地碰到一个在那儿工作的中国人,Ken An (安先生),安告诉李九十天内必须上告联邦法院,不要等待MCAD的调查结果,否则有效期就会过去。
上告岂是易事,李不懂法律,英语又差。李一直在找律师,没有人愿意不收钱接这个案子。时不我待,李从互联网找了一个他人的歧视上告书(Complaint),就比葫芦画瓢写出自己的上告书,距最后期限还差两天,也就是2005年十月七日把雷神公司告上联邦法庭。李以联邦反歧视法第七条(Title VII)告雷神公司种族歧视和报复,以普通侵权法(Common Tort Law)中的以权谋私条例(Tortious Interference with Advantage Relationship)告部门经理Mr. Mitchell和人事部官员Mr. Buliung,以普通侵权法中的故意精神伤害条例(Intentional Infliction of Emotional Distress)告Mr. Buliung,又以普通侵权法中的欺骗条例(Misrepresentation & Deceit)告雷神公司隐瞒医生报告。
2005年底,李索取到了公司的个人党案袋(personnel file),李发现Buliung在所有记录中都把Didio的问题“你是否要杀(kill)人”改成“你是否要害(harm)人”,由此淡化Didio的邪恶。不过Stephanie在公司内部调查时说她“感到李受到白人男性的人身威胁,这在开会时很明显(Stephanie felt that Yong was physically intimidated by white males, it was evident in the meeting with her)”。
其后,李又发现麻省自己还有反歧视法151B,李发动议要求把151B补充进去。谁知联邦法院正处于从邮政文件向电子文件转型期,工作混乱。律师们本来就有法院的电子账号,他们根本不用邮局寄信件。李不是律师,花了两个月才申请到账号。不管是谁的责任,反正李没有收到邮局寄出的法令,十四天一过,法官就不允许李补充151B条例。李不甘心失去法律赋予的权力,她跑到麻省州立法院另辟战场,专告151B,并附告John Didio违法操作(Malpractice)侵犯李的照会权(Right of Consent)和故意精神伤害。
经历了一年多的预审调查取证 以及李 和被告律师之间无休止地扯皮发动议与反动议之后,联邦法官Richard G. Stearns在没有涉入任何具体事实的情况下,不安排听证,不提供口头辩论的机会,而是直接采纳雷神公司提出的动议(Motion)在2006年底进行总结评判(Summary Judgment)。按说总结评判应该以被动方(Nonmoving Party)李提供的事实(Facts)为依据,谁知道法官Stearns却以主动方(Moving Party)雷神公司提出的结论(Conclusion)为依据,草草断案(Enter Judgment)认为歧视和报复不成立。其判词一页纸,没有事实分析,没有法理解释。如此判决真如葫芦僧判葫芦案,荒唐至极,终其原因是因为李是一个pro se,即没有律师全凭自己打官司。法官都不喜欢pro se,只愿意和律师打交道,而李又请不起律师。李向法院内部纪律检查委员会举报法官Stearns歧视pro se,李只想给Stearns留个记录而已。
李来到第一巡回法院开始了上诉行程,这回李有点经验了,她发动议要求三人法官组详细审查案情,并暗示若不公平就告法官。法官也怕告,坏记录多了影响升迁。
2007年九月,巡回法院维持原判,其判决书好几页纸,专门提到因为李2002年告Jen Lewis,2004年才挨整,两年时间太长,消除了因果关系,报复不成立。这是一个大破绽,感谢岳东晓博士,他指出此判决与第六巡回法院和第九巡回法院的判决相矛盾,时间长并不能消除因果关系,原因是李在佛州(Virginia)呆了一年,那些人无机会报复,等李一回到麻省,报复立即开始。第九巡回法院曾经判了一个十年因果关系成立的报复案,原因是十年期间报复者没有机会,一旦受害者回到报复者手下干活,报复立即开始。此案已经造成巡回法院分裂,李要求七人法官团(En Banc)复审。
李还提出要求复审是否“发现原理”(Discovery Rule)可用于第七条,这是因为Mitchell和Ogle牛y散布裁人谎言要李离开公司的事发生在有效期之前(从李告到EEOC的前300天算起,即2004年六月二十五日以前发生的事件不考虑),但是它发生时李并不知道那是报复。直到Ogle牛y在2004年七月二十九日否认他的裁人谎言时李才明白,按照发现原理,报复指控应该从发现那天算起,因此它不算过期。发现原理从来没有用于第七条,联邦最高法院允许自由争辩。目前李在等待七人法官团的判决,下一个目标是联邦最高法院。
李的工伤赔偿案已在2007年六月被据。工伤赔偿法官(Administrative Judge)William Constantino不接受法院法医的报告,其指出李的精神伤害是公司造成的。法官只接受雷神请的Reade医生的观点,Reade医生引用Mattie的秘密报告,那就是李性格有毛病,李个性强,固执,因此造成工作纠纷。Reade医生不重视瞪眼之事,不提Didio的审问,她认为李担心个人安全纯属幻觉,她得出结论李的精神伤害不可能是公司造成的。李的律师也没有争论李的性格问题,其实李的年鉴说“李待人友好,容易相处”,Stephanie在人事部的记录也说李从不与人冲突(she was never confrontational)。法官还接受Buliung, Stephanie 和Didio的谎言“你是否要害人”,不接受李的证词“你是否要杀人”, 法官判Didio的问话不会惊动任何人(Mr. Didio spoke in a way that would not alarm anyone),他认为Didio没有故意骚扰,也没有骚扰李(I find that Mr. Didio did not intent to harass Ms. Li, nor did he harass Ms. Li),李自己胡涂了(but she was confused)。法官给的唯一面子就是承认了Jen Lewis的瞪眼事件。李的律师正在抓住这连续八个月的瞪眼事件做上诉。
由于联邦法官Stearns拒绝受理李的普通侵权条例,李的州立法院的案子还在进行。

李是那种不到完美不说好的人,这也她为什么吃亏,老美不好也说好,文化差异。试
想她能单枪匹马打上巡回法院,不要说英语,繁复琐碎法庭程序就不是一般人能做
到,她的英语能差吗?

5楼的, 就象3楼说的那样, 如果英文不好, 怎么能够单枪匹马告上巡回法院? 如果英文好, 那么前面文章不就是p话?

6楼的,如果瞪眼只是幻觉,那她确实有问题,但是既然法官承认瞪眼事件,而且是八个月连
续瞪眼,还不把她瞪死,她的担心就有道理。
担心是一种本能,正是因为她事事叫唤出来,留下痕迹,法官才会承认瞪眼事件,
这在法庭上已经是一个突破。
还有,她见READE医生时就讨要评估报告,公司还是拖一年才给她。此一点就证明她
的判断和感觉是准确的。

7楼的,她讨要医生报告是因为她知道公司会隐瞒报告,因为公司已经隐瞒人事部调查报告。
公司总是强调隐私和保密。她的感觉只是正常人的感觉,算不上灵敏。

这个就能受到极度惊吓? 也太不可信了吧. 我觉得Didio是觉得她脑子有问题了.
另外法官承认瞪眼事件只是承认说李讲过这件事, 因为谁都没有看到阿.
设身处地的想一想吧, 如果一个女的说另外一个人老是朝她瞪眼, 因此她觉得自己又可能被杀, 你是不是觉得她有神经病?

一,记住,李一直以为Didio是调查员,是为了她的自身安全来开会;
二,任意给雇员做精神评估是侵权行为,本身就是harassment, 除非你是受虐狂;
三,公司从来不给李看任何报告,藉口是保密和隐私。如果当时有中国人在场,Didio还
敢问“你要杀人吗?” 这个问题本身就有虐待性;
四,李已经拒绝签字,Didio已经知道李不明白开会的目的是评估,Didio就应该向
李解释清楚,而不应该没有取得照会权直接问问题;实际上Didio可能认识到一旦李
明白开会的目的,李就会停止开会,所以Didio要出其不意先斩后奏剥夺李的照会权;

The three judges of panel denied my Motion for oral argument. I sensed that they are going to dismiss my appeal without provide detail analysis. Actually, the district court dismissed my case without touch on the main alleged misconduct in my case. What should I do if all the judges do not want to deal a case filed by a pro se?

Mr. Didio did not ask Li why she felt unsafe, the first question he asked was “Do you want to kill someone?” Li answered “For this question, you should ask them,” Didio became exciting, he performed very sneaky and sneering face and stared at Li, just like a hungry animal met his prey, and asked “Do you want to [kill someone] or do you want to [kill yourself]…” each “Do you want to” followed a finger pointing at Li. The court agrees with Raytheon that Li’s claims fail because, among other things, she is an at-will employee, there is no competent evidence that Raytheon treated Li differently than any other employee, Li presents no competent evidence of retaliatory acts, that she suffered an adverse employment action, that Raytheon engaged in misconduct in its handling of her internal discrimination complaint or the investigation of her failure to return to Raytheon after the expiration of her Family Medical Leave Act (FMLA) leave. Accordingly, for the reasons stated in their supporting memorandum, the motion of defendants Raytheon Company, Ian C. Mitchell, and Arthur Buliung for summary judgment is ALLOWED on Li’s federal claims2.

However, I never alleged the FMLA, it was Raytheon’s tactics. The core of the case is the imposed homicide interrogation and I was traumatized (I had no history of mental illness before). I spent two years to cover my judgment, and could not able to find an attorney to help me.
I have been U.S. since 1998. English is most problem for me. However, a lisenced social worker should not evaluation a client if he could not communicate with him/her.

Is the imposed homicide interrogation, turning back a victim to a potential murder, not an EVIDENCE? Do you know John McDonough v. City of Quincy, McDonough worried about his safety under retaliation, he reported to his leaders and was ordered to see a psychiatrist.

They did not tell me the meeting was a mental evaluation, I had no idea of mental evaluation. I thought John Didio was an investigator. When he asked me to sign a confidentiality form, I declined and said “confidential is dirty”. When he pointed at me and asked “Do you … Do you…” I said “I’m the victim. I don’t want to talk to you.” He left the meeting room. However, he came back after a few minutes and continued asking question, I was agitated again and rejected him again.
After the meeting, nobody told me the result of the evaluation. They stripped my right of consent.
If no case, what about the damage? [long term disability]

You seem knowing my case very much. Who are you? When you call me a nut, do you show that you are an offensive person. Yes, I suffered PTSD now, but it was caused by Raytheon’s misconduct, for I had no mental history before. Just think about it, if all the Jennifer Lewis, the sexy white female manager, were mentally raped, will you still say Raytheon is not liable?
“over react”? Turning back a victim to a potential murder is not only over react, is evil.

Supposedly John Didio has right to ask me freaking question, while he stripped my right of consent, he did not ask why I felt unsafe, and this is undispute.
The first question he asked was “Do you want to kill someone”. Arthur Buliung surreptitionsly changed “kill” to “harm/hurt”, I found it out after a year when I received my personnel file. Why they changed?
When I asked MaryAnn King, Arthur Buliung, and Paul Clegg for why John Didio treated me as a potential murder, they all answered “Because that email [concerned about my personal safety and family safety].” Nobody denied that he did not treated me as a potential murder at that time. It was you voluntarily contested his behavior.

They did not claim you were a potential murderer. They were asking you a freaking question. The fact you think otherwise is not their fault. Nothing you wrote shows they ever called you or inferred you were a muderer. They were asking you how you felt.
